<br />236. <br /> <br />Memorandum of Understanding <br />Regarding <br />Interpretive Center <br /> <br />This Memorandum of Understanding (MOU), dated September 4, 2003, is between the City of <br />San Marcos (City) and Texas State University-San Marcos (Texas State). <br /> <br />1. Background <br /> <br />1.01. The City owns an Interpretive Center near the intersection of IH-35 and Riverside Drive in <br />San Marcos, Texas. The Interpretive Center is used to grow native plants, create native <br />landscapes, act as a trailhead for the Texas Parks and Wildlife Department's Central <br />Texas Birding Trail, and to provide environmental educational opportunities for the <br />citizens of San Marcos and the San Marcos Independent School District in order to fulfill <br />the mitigation measures as set forth in the San Marcos River Habitat Conservation Plan <br />(SMRHCP). <br /> <br />1.02. The Department of Agriculture at Texas State has faculty with expertise in these matters <br />and desires to provide its students with work and research opportunities at the <br />Interpretive Center. The purpose of this MOU, therefore, is to set forth the terms under <br />which Texas State will provide services to the City's Interpretive Center. <br /> <br />2. Term <br /> <br />2.01. This MOU will become effective on September 4, 2003 and will continue in effect until <br />either party gives at least 30 days' written notice of termination to the other party. <br /> <br />3. Responsibilities <br /> <br />3.01. Texas State will provide the following services for the Interpretive Center: <br /> <br />a. The services of a graduate student to coordinate educational events involving <br />native, well-adapted and recommended plants for the area that can be used for <br />landscape gardens. Both parties will approve decisions regarding plant material <br />installed on the site before installation occurs. <br /> <br />b. The services of undergraduate students to assist with maintaining garden plots <br />and the surrounding grounds. <br /> <br />c. A monthly plan for educational programs that are suitable for adults and/or <br />school-aged children at the Interpretive Center. <br /> <br />d. Presence at the Interpretive Center to interact with visitors. <br /> <br />e. All events, programs, etc. will be coordinated through the Watershed Protection <br />Manager in order to ensure fulfillment of SMRHCP mitigation measures. <br /> <br />f. Efforts will be made to advertise events on the city web page, in the local <br />newspaper, on the cable access channel or with fliers. <br /> <br />3.02. The City will provide and pay for utilities, custodial services, and grounds maintenance at <br />the Interpretive Center during the term of this agreement. The term "utilities" includes <br />local telephone and fax service, electricity, water, gas, sewage, and trash removal. <br />Texas State will pay for its own long distance telephone calls and fax messages. <br />
