<br />3.03. The parties will collaborate in seeking external funding for programs that would be of <br />mutual benefit. Each party will disclose to the other all grant proposals related to this <br />project before submitting the proposals to the granting agencies. The parties will <br />cooperate in developing a master plan for the interpretive center. They will coordinate <br />efforts to: <br /> <br />a. Secure funding through grants; <br /> <br />b. Develop educational programs; <br /> <br />c. Establish an arboretum along the San Marcos River; and <br /> <br />d. Develop a plan to preserve the river habitat and associated green spaces. <br /> <br />3.04. This agreement serves a public purpose in that it permits Texas State to fulfill its mission <br />of providing service to the San Marcos community. It also provides reseårchand <br />educational opportunities for Texas State's faculty and students. <br /> <br />4. General Provisions <br /> <br />4.01. The parties will construe this agreement under the laws of the State of Texas and will <br />perform all their obligations in Hays County, Texas. <br /> <br />4.02. This is the only agreement of the parties respecting this subject, and it supersedes any <br />prior written or oral agreements between the parties regarding this subject. <br /> <br />4.03. The parties may not amend this agreement except in writing, dated after the date of this <br />agreement and signed by each party's representative. <br /> <br />4.04. A party must provide any notice required or permitted in this agreement: (1) in writing and <br />(2) delivered either in person or by certified mail, return receipt requested, postage <br />prepaid, to the person and address shown below: <br /> <br />a. The notice will be effective on the date of delivery. <br /> <br />4.05.
