Mr. Thomaides inquired if this <br />Ordinance is voted down, if the City would still have an Ethics Review <br />Commission. Mr. Mark Taylor stated yes the City would still have an <br />Ethics Review Commission. Mr. Taylor stated he feels the amendments were <br />written to try to keep different citizens from filing ethics charges, <br />groundless or not, right before an election. He stated he would rather <br />have the third amendment in the Ordinance and then change it in January, <br />rather than vote it down now. Mr. Thomaides stated this was extended to <br />December 31, 2004, and that was an arbitrary date. He also inquired <br />whether the Ethics Review Commission could make their recommendations <br />earlier than December, 2004. Mr. Mark Taylor stated it could be possible <br />that the Ethics Review Commission could resolve their studies quicker than <br />in a three or four month period. The Council agreed by consensus for the <br />Ethics Review Commission to make their recommendations by November 30, <br />2004. On roll call the following vote was recorded: <br /> <br />AYE: Taylor. <br /> <br />NAY: Diaz, Guerrero, Mihalkanin, Narvaiz, Thomaides and Bose. <br /> <br />ABSTAIN: None. <br /> <br />The motion for adoption of the Ordinance on third and final reading <br />failed. <br /> <br />Mayor Narvaiz introduced for consideration approval of minutes of the <br />Regular Meeting held June 28, 2004, approval of minutes of the Special <br />Meeting held July 6, 2004, approval of two Ordinances on second reading, <br />adoption of one Ordinance on third and final reading, adoption of thirteen <br />Resolutions, approval for use of Water/Wastewater Utility Fund contingency <br />funds in the amount of $100,000.00 for legal counsel and emergency repairs <br />to the Wastewater Treatment Facility and approval to solicit bids for the <br />sale of Lots 6 and 7, Block 19, Victory Gardens #2, and Lots 1 and 2, <br />Block 24, Victory Gardens #2, on consensus. The Council removed Item 19, <br />adoption of an Ordinance on third and final reading, Items 23 and 24, <br />adoption of Resolutions, and Item 33, approval for use of Water/ <br />Wastewater Utility Fund contingency funds in the amount of $100,000.00 for <br />legal counsel and emergency repairs to the Wastewater Treatment Facility, <br />to be considered separately. Mr. Mihalkanin moved for approval of minutes <br />of the Regular Meeting held June 28, 2004, approval of minutes of the <br />Special Meeting held July 6, 2004, approval of two Ordinances on second <br />reading, adoption of eleven Resolutions, and approval to solicit bids for <br />the sale of Lots 6 and 7, Block 19, Victory Gardens #2, and Lots 1 and 2, <br />Block 24, Victory Gardens #2, on consensus and Mr. Guerrero seconded the <br />motion, which passed unanimously (Mayor Narvaiz abstaining from Item 31, <br />adoption of Resolution) The captions of the Ordinances and Resolutions <br />read as follows: <br /> <br />Approval of Ordinances on second reading: <br />
