<br />35. <br /> <br />Regular Meeting <br /> <br />July 12, 2004 <br /> <br />Page 6 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 326 ACRES, MORE OR <br />LESS, LOCATED ADJACENT TO AND NORTH OF THE RIDGE AT STONECLIFF AND <br />THE WILLOW CREEK SECTION 9 SUBDIVISIONS (NORTH OF THE 2200-2600 <br />BLOCKS OF SUMMIT RIDGE DRIVE) (PURGATORY GREENSPACE TRACT); APPROVING <br />A SERVICE PLAN FOR THIS TRACT; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Thomaides moved for approval the Ordinance on first reading and Mr. <br />Bose seconded the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration removal from table and approval <br />of an Ordinance on third and final reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2, ARTICLE 5 OF THE CITY CODE TO PROVIDE TIME <br />LIMITATIONS FOR ETHICS COMPLAINTS RELATED TO CITY COUNCIL MEMBERS; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved to remove from the table and Mr. Thomaides seconded <br />the motion, which passed unanimously. Mr. Thomaides moved for adoption of <br />the Ordinance on third and final reading and Mr. Mihalkanin seconded the <br />motion. Mr. Thomaides stated the memo the Council received states the <br />Ethics Commission changes which were made last year. He stated one of the <br />three changes made to the Ordinance went to the Ethics Review Commission <br />for their consideration. He also stated the Ethics Review Commission is <br />asking for this Ordinance to be tabled until December 31, 2004, so they <br />may have time to fully explore this issue. Mayor Narvaiz stated the Ethic <br />Review Commission is asking the Council to table consideration until the <br />first meeting in January, 2005 so they can continue to look at other <br />municipalities' Ethics Ordinances. She also stated she understands the <br />Ethics Review Commission is going to conduct their own hearings to get <br />input. She stated the Ethic Review Commission will then bring a <br />recommendation back to the Council. Mr. Mihalkanin stated he feels this <br />Ordinance should be voted on and after the Council receives a <br />recommendation from the Ethics Review Commission, then the Council can <br />begin the Ordinance process again. Mr. Mark Taylor stated if the Council <br />votes this Ordinance down on third and final reading, then the Council <br />would begin again with recommendations from the Ethics Commission. Mayor <br />Narvaiz inquired as to the changes the Council had already made. Mr. Mark <br />Taylor stated the two amendments that the Council voted to approve would <br />remain on the books. Mr. Thomaides stated he would like to see this <br />Ordinance be brought back on the first meeting in January with the <br />recommendations. Mayor Narvaiz stated if the Council were to vote this <br />Ordinance down, then the Ethics Commission can come back in January with <br />their recommendation. She also stated if the Council does not wish to <br />vote down the Ordinance, then the Council would need to make another <br />motion to table.
