26. Public Hearing to receive comments for and against an amendment to the future • <br />land use map from "I" Industrial, to "C" Commercial for a 202 acre, more or less <br />piece of land, and from "I' Industrial to "OS" Open Space for a 57.6 acre more or <br />less piece of land both pieces being out of the Nathaniel Hubbard Survey Abstract <br />230 and the Cyrus Wickson Survey Abstract 474; and amending the official zoning <br />may of the City to establish the zoning for those tracts of land as a "PDD" Planned <br />Development District with base zoning of "GC" General Commercial District (63.2 <br />acres, more or less, and 12.6 acres, more or less), "CC" Community Commercial <br />District (78 acres, more or less, and 48.2 acres more or less), and "P" Public <br />District, 57.5 acres, more or less; approving a land use plan and development <br />standards for the McCarty Commons PDD; and consider adoption of Zoning <br />Ordinance 2008-41. <br />Mayor Narvaiz opened the Public Hearing at 12:16 a.m. There being no public <br />comments, Mayor Narvaiz closed the Public Hearing at 12:16 a.m. <br />No action was required by Council at this time. <br />27. Public Hearing to receive comments for and against amending the official zoning <br />may of the City by rezoning 28.68+/ acre, more or less tract of land from General <br />Commercial District (GC) to Light Industrial District (LI); located in the 2500 block <br />of Hunter Road near the intersection of Hunter Road and Foxtail Run, and consider <br />adoption of Ordinance 2008-42. <br />Mayor Narvaiz opened the Public Hearing at 12:17 a.m. There being no • <br />g g public <br />comments, Mayor Narvaiz closed the Public Hearing at 12:17 a.m. <br />MOTION: Upon a motion made by Councilmember Jones and a second by <br />Councilmember Guerrero, the City Council voted seven (7) for and none (0) opposed, to <br />approve Ordinance 2008-42, as previously captioned. The motion carried unanimously. <br />28. Consider adoption of Resolution 2008-116R, approving the sale by Tax Resale <br />Deed of a tract of real property described as Lot 9, Block 34, Second Section of <br />Victory Gardens Subdivision by the San Marcos Consolidated Independent School <br />District, Trustee, to J.W. Concepts, Inc.; authorizing the Mayor to execute a Tax <br />Resale Deed for such purpose; and declaring an effective date. <br />MOTION: Upon a motion made by Councilmember Guerrero and a second by <br />Councilmember Bose, the City Council voted seven (7) for and none (0) opposed, to <br />approve Resolution 2008-116R, as previously captioned. The motion carried <br />unanimously. <br />29. Question and answer session with press and public. <br />Theron Brittain, with the University Star, asked where the rate increase for <br />water/wastewater was left.
