21. Consider adoption of Ordinance 2008-36, setting the tax rate for the 2008 tax • <br />year; levying taxes for the use and support of the municipal government of the City <br />for the fiscal year beginning October 1, 2008, and ending September 30, 2009; <br />providing a sinking fund for the retirement of the bonded debt of the City, <br />including procedural provisions; and declaring an emergency. <br />MOTION: Upon a motion made by Councilmember Jones and a second by <br />Councilmember Guerrero, the City Council voted seven (7) for and none (0) opposed, to <br />approve Ordinance 2008-36, as previously captioned, on emergency. The motion carried <br />unanimously. <br />22. Consider adoption of Ordinance 2008-37, authorizing the issuance and sale of <br />City of San Marcos, Texas Combination Tax and Revenue Certificate of Obligation <br />Series 2008A; providing for the security for and payment of said certificate; <br />prescribing the form of said certificate; awarding the sale thereof, authorizing a <br />Paving Amt/ReOstrar Agreement and an Investment Letter, and enacting other <br />provisions relating to the subject. <br />MOTION: Upon a motion made by Councilmember Couch and a second by <br />Councilmember Thomaides, and amended by Councilmembers Thomaides and Bose, the <br />City Council voted six (6) for and none (0) opposed, to approve Ordinance 2008-37, as <br />previously captioned, and amended to reflect the winning rate of 4.61 with Bank of <br />America. The motion carried unanimously. <br />23. Consider adoption of Ordinance 2008-38 authorizin the issuance of City of San <br />Marcos, Texas Combination Tax and Subordinate Lien Revenue Refundin Bond <br />Series 2008, providing for the security for and payment of said bond; authorizing a <br />Paving Aunt/ReOstrar Agreement, an Escrow Agreement and an Investment <br />Letter; awarding the sale thereof, calling certain obligations for redemption; and <br />enacting other provisions relating to the subiect. <br />MOTION: Upon a motion made by Councilmember Jones and a second by <br />Councilmember Couch, the City Council voted six (6) for and none (0) opposed, to table <br />this item. The motion carried unanimously. <br />24. Public Hearing to receive comments for and against an amendment to the future <br />land use map from Low Density Residential (LDR) to Mixed Use (MU) for a 0.6014 <br />acre, more or less, tract of land located at 408 Valley Street; amending the official <br />zoning map of the City by rezoning this tract from Single Family Residential <br />District (SF-6) to Mixed Use District (MU); and consider adoption of Zoning <br />Ordinance 2008-39. <br />Mayor Narvaiz opened the Public Hearing at 12:15 a.m. There being no public <br />comments, Mayor Narvaiz closed the Public Hearing at 12:15 a.m. <br />0
