<br />91. <br /> <br />Regular Meeting <br /> <br />July 26, 2004 <br /> <br />PagelS <br /> <br />the committee is direct to focus on the Parks and Public Buildings, Public <br />Safety, and Street Improvement capital improvement projects listed on the <br />attached spreadsheet under the column the "Blue Ribbon Bond Committee". <br />The Council then voted unanimously for adoption of the Resolution. <br />Mayor Narvaiz introduced for consideration approval of placement of <br />buildings on the Mitchell Center site in the 700 Block of Valley Street <br />and approval of design of proposed buildings, subject to compliance with <br />construction, site development, floodplain, off-street parking and all <br />other applicable regulations. Mayor Narvaiz stated a citizen has signed up <br />to speak on this issue. 1) Denise Bindle stated she supports the placing <br />of buildings at the Mitchell Center site. She stated she has a special <br />needs son who benefits greatly from attendance at the Preparatory School. <br />She encouraged the Council to allow the Mitchell Center to place the <br />proposed buildings at their site. Mr. Guerrero moved for approval of <br />placement of buildings on Mitchell Center site in the 700 Block of Valley <br />Street and approval of design of proposed buildings, subject to compliance <br />with construction, site development, floodplain, off-street parking and <br />all other applicable regulations, and Mr. Thomaides seconded the motion. <br />Mr. Mihalkanin inquired who the lease for this property is with. Mr. Mark <br />Taylor stated the piece of property at the 700 Block of Valley Street was <br />leased originally to the NAACP organization for a thirty year term in July <br />of 1994. He stated this site now serves as the location for the Mitchell <br />Center office, which holds the current lease. He also stated the lease <br />allows additional structures, over and above the restored building, to be <br />placed on the site. He also stated all structures that are placed or <br />constructed on the site are to be in compliance with all City Ordinances, <br />Rules and Regulations and they must obtain approval of the design of <br />additional structures to be placed or constructed on the property, from <br />the City. He stated the Council needs to review and approve the design of <br />the proposed additional buildings. Mr. Mihalkanin asked whether the <br />NAACP, under the terms of the lease agreement with the City, transfer or <br />sublease the land and the building to anybody else. Mr. Mark Taylor <br />stated the lease provides an assignment of the lease by the NAACP to any <br />other entity required the approval of the City, which was obtained from <br />the Council in 1998 or 1999 time frame. Mr. Mihalkanin inquired how the <br />Mitchell Center is different from the Boys' and Girls' Clubs in terms of <br />its legal representation, such as the officers, a non-profit corporation, <br />names of Board Members and when they meet. Mr. Mark Taylor stated he does <br />not have that information. Mr. Mihalkanin stated he is very sYmpathetic <br />to the families and to the children who have gotten some help from the <br />Center, but he is concerned about who has the legal responsibility for the <br />Mitchell Center and the current lease of the building. He stated he wants <br />to table this item to get additional information. Mr. Taylor stated he <br />will get the additional information about the structure, the Board <br />members, meetings and the placement of the structure on the site. Mr. <br />Bose inquired whether this should go before the Planning and Zoning <br />Commission before it comes to the Council. Mr. O'Leary stated they will <br />need to go through the city's building process, but he feels they do not <br />
