<br />179. <br /> <br />Regular Meeting <br /> <br />August 23, 2004 <br /> <br />Page 10 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE SALE OF LOTS 10 AND 11, MUNICIPAL AIRPORT SUBDIVISION, <br />LOCATED IN THE 2500 BLOCK OF INTERSTATE HIGHWAY 35 SOUTH, TO SCOTT D. <br />RABBIT; AUTHORIZING THE CITY MANAGER TO EXECUTE A SPECIAL WARRANTY <br />DEED; AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Thomaides moved for approval of the Ordinance on first reading, and <br />Mr. Guerrero seconded the motion. Mr. O'Leary stated Council approved a <br />motion item regarding the sale of Lots 10 and 11 of the Municipal Airport <br />Subdivision. He stated the sale of these lots ran twice in the newspaper <br />and the City only received one bid. He stated Scott Habbit owns the <br />property next to Lot 11 and he bid on both Lots 10 and 11. Mr. Bose <br />inquired whether there were any more lots left in the Subdivision. Mr. <br />O'Leary stated there are no more lots after Lots 10 and 11. On roll call <br />the following vote was recorded: <br /> <br />AYE: <br /> <br />Diaz, Mihalkanin and Bose. <br /> <br />NAY: <br /> <br />Guerrero, Narvaiz and Thomaides. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ADOPTING A REVISED SECTOR ONE PLAN; INCLUDING PROCEDURAL PROVISIONS; <br />AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on second reading, and <br />Mr. Bose seconded the motion. Jon James, Chief Planner, stated the two <br />main changes the Council made at the last Regular Meeting are identified <br />in the memo attached to the Ordinance. He stated one change was the re- <br />designation of the Carson tract to a Mixed Use designation, and the other <br />change was to the existing neighborhoods reverting back to maintaining a <br />predominantly Single-Family neighborhood. He inquired whether it was the <br />Council's intent for the front of the Carson tract to be part of the <br />Mixed-Use neighborhood, or if it was intended to stay Commercial as it is <br />currently designated. He stated Council could designate the back seventy <br />to eighty acres as a Mixed-Use Neighborhood designation. The Council <br />agreed by consensus to revise the Future Land Use Map for the Carson tract <br />to be designated as Mixed-Use Neighborhood for the third reading. Mr. <br />Mihalkanin inquired as to the process if a piece of property is <br />misidentified for zoning purposes on the Land Use Map. Mr. James stated <br />the citizen would need to contact the Planning and Development Office to <br />investigate and to change the map if it was necessary. He stated this <br />
