<br />178. <br /> <br />Regular Meeting <br /> <br />August 23, 2004 <br /> <br />Page 9 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />SETTING THE TAX RATE FOR THE 2004 TAX YEAR; LEVYING TAXES FOR THE USE <br />AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY FOR THE FISCAL <br />YEAR BEGINNING OCTOBER 1, 2004, AND ENDING SEPTEMBER 30, 2005; <br />PROVIDING A SINKING FUND FOR THE RETIREMENT OF THE BONDED DEBT OF THE <br />CITY; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Guerrero moved for adoption of the Ordinance on emergency, and Mr. <br />Thomaides seconded the motion. Mr. O'Leary stated the tax rate is the <br />same rate as last year. The Council then voted unanimously for adoption <br />of the Ordinance on emergency. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING DIVISION 3 OF ARTICLE 3 OF CHAPTER 2 OF THE CITY CODE TO <br />CHANGE THE NAME OF THE uMINORITY ECONOMIC DEVELOPMENT AND TOURISM <br />DEVELOPMENT ADVISORY BOARD" TO THE uMINORITY ECONOMIC AND TOURISM <br />DEVELOPMENT BOARD"; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mr. Mihalkanin moved for approval of the Ordinance on first reading, and <br />Mr. Guerrero seconded the motion. Mayor Narvaiz inquired whether the <br />contract language has been changed as the Council requested. Mr. Mark <br />Taylor stated this proposed Ordinance is for the name change. The Council <br />then voted unanimously for approval of the Ordinance on first reading. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 86.200 OF THE CITY CODE RELATED TO DELINQUENCIES IN <br />UTILITY PAYMENTS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mr. Diaz moved for approval of the Ordinance on first reading, and Mr. <br />Guerrero seconded the ~otion. Rodney Gonzales, Director of Finance, <br />stated the disconnect policy procedures in the current Ordinance needed <br />clarification. Mr. Bose inquired if bills are consolidated, how the <br />electric bill would be affected differently because of State Law. Mr. <br />Mark Taylor stated some laws at the State level for different types of <br />utilities do not apply to Municipalities. Mr. Gonzales stated there is 8 <br />days before disconnect and the City bills 30 days after they have already <br />received the utilities. He stated they also take into consideration <br />financial difficulties. The Council then voted unanimously for approval <br />of the Ordinance on first reading. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br />
