Regular Meeting August 23, 2004 Page 9 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, SETTING THE TAX RATE FOR THE 2004 TAX YEAR; LEVYING TAXES FOR THE USE AND SUPPORT OF THE MUNICIPAL GOVERNMENT OF THE CITY FOR THE FISCAL YEAR BEGINNING OCTOBER 1, 2004, AND ENDING SEPTEMBER 30, 2005; PROVIDING A SINKING FUND FOR THE RETIREMENT OF THE BONDED DEBT OF THE CITY; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EMERGENCY. Mr. Guerrero moved for adoption of the Ordinance on emergency, and Mr. Thomaides seconded the motion. Mr. O'Leary stated the tax rate is the same rate as last year. The Council then voted unanimously for adoption of the Ordinance on emergency. Mayor Narvaiz introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING DIVISION 3 OF ARTICLE 3 OF CHAPTER 2 OF THE CITY CODE TO CHANGE THE NAME OF THE uMINORITY ECONOMIC DEVELOPMENT AND TOURISM DEVELOPMENT ADVISORY BOARD" TO THE uMINORITY ECONOMIC AND TOURISM DEVELOPMENT BOARD"; AND INCLUDING PROCEDURAL PROVISIONS. Mr. Mihalkanin moved for approval of the Ordinance on first reading, and Mr. Guerrero seconded the motion. Mayor Narvaiz inquired whether the contract language has been changed as the Council requested. Mr. Mark Taylor stated this proposed Ordinance is for the name change. The Council then voted unanimously for approval of the Ordinance on first reading. Mayor Narvaiz introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING SECTION 86.200 OF THE CITY CODE RELATED TO DELINQUENCIES IN UTILITY PAYMENTS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mr. Diaz moved for approval of the Ordinance on first reading, and Mr. Guerrero seconded the ~otion. Rodney Gonzales, Director of Finance, stated the disconnect policy procedures in the current Ordinance needed clarification. Mr. Bose inquired if bills are consolidated, how the electric bill would be affected differently because of State Law. Mr. Mark Taylor stated some laws at the State level for different types of utilities do not apply to Municipalities. Mr. Gonzales stated there is 8 days before disconnect and the City bills 30 days after they have already received the utilities. He stated they also take into consideration financial difficulties. The Council then voted unanimously for approval of the Ordinance on first reading.
