<br />Regular Meeting <br /> <br />August 23, 2004 <br /> <br />174. <br />Page 5 <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. 1) Terry Mitchell, stated he is one of the developers of the <br />proposed development of the First Baptist Church into housing and a few <br />shops. He stated this is an urban housing project to preserve the <br />building and to make the surrounding area more attractive. Mayor Narvaiz <br />asked if anyone else wished to speak. No one did, so Mayor Narvaiz closed <br />the public hearing. Mr. Thomaides moved for adoption of the Zoning <br />Ordinance with amendment provided by Mr. Mark Taylor by memorandum dated <br />August 23, 2004, and Mr. Guerrero seconded the motion. Mr. Thomaides <br />inquired as to parking on Hutchison Street. Ms. Barrett stated there is <br />enough proposed off-street parking planned for residential units and for <br />two hour shopping. She stated the parking on Hutchison is designed to be <br />at an angle, which will allow additional parking. Mr. Thomaides inquired <br />as to sidewalks proposed on the information provided to the Council. Ms. <br />Barrett stated the developers are proposing to add sidewalks, street <br />lamps, benches and trees. Mr. Thomaides inquired whether the City can <br />prohibit the developers from selling this property to Texas State <br />University. Mr. Mitchell stated he is not the sole owner of the project, <br />but it is not his intention to sell to the University. Mr. Bose stated <br />the map attached to the Zoning Ordinance shows a new street on the north <br />side. Ms. Barrett stated the Transportation Master plan considers this <br />street as a future street, and the developers will deed this street to the <br />City. Mayor Narvaiz inquired whether an agreement could be executed with <br />financial penalties if the developers sell to the University. Mr. Mark <br />Taylor stated he would have to research whether a penalty for selling to <br />the University can be assessed. The Council then voted unanimously for <br />adoption of the Zoning Ordinance. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption <br />of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY ZONING 318.105 ACRE <br />TRACT OF PROPERTY LOCATED IN THE 2900 BLOCK OF IH-35 NOUTH TO UC" <br />COMMERCIAL DISTRICT (50.919 ACRES), ULI" LIGHT-INDUSTRIAL DISTRICT <br />(38.718 ACRES) AND UR-1" SINGLE-FAMILY DWELLING DISTRICT (LOW <br />Density) (228.468 ACRES); MAKING CONCURRENT AMENDMENTS TO THE FUTURE <br />LAND USE MAP; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. 1) Steele Johns, of Goodrich Corporation, stated he is opposed <br />this zoning change. He stated part of this property included in this <br />rezoning is owned by Goodrich. He stated he has concerns of the effect <br />this zoning change will have on the environment and future of Goodrich. <br />Mayor Narvaiz asked if anyone else wished to speak. No one did, so Mayor <br />Narvaiz closed the public hearing. Mr. Mark Taylor stated he received a <br />fax from the applicant requesting this Zoning issue go back to the <br />Planning and Zoning Commission to clarify public concerns. Carol Barrett, <br />
