<br />173. <br />Regular Meeting <br /> <br />August 23, 2004 <br /> <br />Page 4 <br /> <br />for Master Auto, which is located in the same area. Ms. Barrett, Director <br />of Planning and Development, stated yes, Master Auto was required to <br />follow a similar zoning process. She stated she feels rezoning to C-2 <br />Heavy Commercial District could attract more businesses. Mr. Thomaides <br />inquired whether the open lot would be used for storing wrecked cars. <br />Alan Wiley, applicant, stated the fence would be moved up to the building <br />to enclose the open lot, but there would be a front entrance. He also <br />stated there will be wrecked cars located there temporarily until they are <br />moved. Mr. Thomaides stated he is concerned with wrecked cars being <br />located along the frontage road. He stated he is okay with moving the <br />wrecked cars to the back, but concerned with the additional businesses <br />this zoning would attract. On roll call the following vote was recorded: <br /> <br />AYE: Diaz and Bose. <br /> <br />NAY: Guerrero, Mihalkanin, Narvaiz and Thomaides. <br /> <br />ABSTAIN: None. <br /> <br />The motion failed. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption <br />of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 0.3774 <br />ACRE TRACT OF LAND LOCATED AT 122 NANCE STREET FROM UM" SINGLE- <br />FAMILY, DUPLEX AND NEIGHBORHOOD BUSINESS DISTRICT TO UR-2" SINGLE- <br />FAMILY DWELLING DISTRICT (MEDIUM DENSITY); INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. <br />Thomaides moved for adoption of the Zoning Ordinance, and Mr. Guerrero <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and adoption <br />of a Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 3.67 ACRE, <br />MORE OR LESS, TRACT OF PROPERTY LOCATED AT 330 WEST HUTCHISON STREET <br />AND 400 NORTH STREET FROM UP" PUBLIC AND INSTITUTIONAL DISTRICT TO <br />UPDD" PLANNED DEVELOPMENT DISTRICT (WITH BASE ZONING OF ULB" LIMITED <br />BUSINESS DISTRICT); APPROVING A LAND USE PLAN AND DEVELOPMENT <br />STANDARDS; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />
