"13-1 ", attached hereto and made apart hereof for all purposes, in accordance with <br />applicable City of San Marcos standards. <br />2.06. Job Creation. Developer shall, as of December 31, 2012, have created five full- <br />time jobs, in accordance with the schedule of jobs and salary levels as set forth in Exhibit "C ", <br />attached hereto and made a part hereof for all purposes. To qualify as a full -time job, a position <br />must require at least 1,820 hours of service annually. Persons holding such jobs shall be <br />residents of the City of San Marcos. Developer shall, thereafter, keep such positions filled until <br />the expiration of the term of this Agreement. It is understood, however, that, in the routine <br />course of business, temporary job vacancies may arise. Reasonable allowance is, therefore, <br />made to Developer for normal temporary vacancies in any position. For any vacancy lasting <br />more than 90 days during any calendar year during the term of this Agreement, Developer shall, <br />upon request of the City, submit evidence satisfactory to the City of its good faith efforts to fill <br />such vacancy. The Developer will be in compliance with this Section if it is making a good faith <br />effort to fill such vacancy. <br />Section 2.07. Hiring of Local Contractors. For purposes of this Agreement, "Local <br />Contractors" are those contractors and subcontractors whose principal place of business or <br />primary residence is in San Marcos, Texas or within its extraterritorial jurisdiction of three and <br />one -half miles. At least 20 percent of the total cost of the work on the Project shall be performed <br />by Local Contractors. In selecting contractors and subcontractors for the Project, the Developer <br />shall provide at least 14 days' notice of the solicitation of bids in a newspaper of general <br />circulation as customarily used by the City for solicitation of bids and in any online publications <br />customarily relied upon by local contractors and developers to solicit bids for construction <br />goods, supplies, materials and services.
