<br />A. The one-way transmission to customers of: <br /> <br />1. video programming provided by, or comparable to video programming provided by, a <br />television broadcast station; or <br /> <br />2. other programming services, by which is meant video, audio, or data information that <br />Licensee makes generally available to all customers, to the extent the services are deemed <br />to be "cable service" under federal law; and <br /> <br />B Customer interactive (two-way) transmissions required for the selection or use of <br />video programming or other programming services (such as, for example, customers' accessing <br />and utilization of data bases, the Internet, video game services, or other services), to the extent <br />they are "cable service" under federal law. <br /> <br />1.05. City Facilities means the electric distribution system facilities and equipment owned or <br />controlled by the City, including the Poles. <br /> <br />1.06. Communications Service means the provision of Telecommunications Service, Information <br />Service or Cable Service over wire, cable or wireless facilities utilizing Attachments to the Poles. <br /> <br />1.07. Conduit System means the underground conduit, Innerduct, manholes, vaults, risers, pull- <br />boxes and trenches of the City's electric utility system. <br /> <br />1.08. Information Service means the offering of a capability for generating, acquiring, storing, <br />transforming, processing, retrieving, utilizing, or making available information via <br />telecommunications, and includes electronic publishing, but does not include any use of such <br />capability for the management, control, or operation of a telecommunications system or the <br />management of a telecommunications service. <br /> <br />1.09. Licensee's Facilities means all of the Licensee's Attachments, and all other cables, wires, <br />all associated equipment used by the Licensee in the City to provide or facilitate <br />Communications Service. <br /> <br />1.10. Make-Ready Work means all work on the City Facilities determined by the City to be <br />required to accommodate the Licensee's Attachments or to comply with all of the Applicable <br />Standards. Make-Ready Work includes, but is not limited to, rearrangement or transfer of <br />existing Attachments, inspections, engineering work, permitting work, tree trimming, and the <br />installation, upgrade, strengthening, or replacement of Poles. <br /> <br />1.11. Other Licensee means a person or entity other than the Licensee with which the City has <br />executed a license agreement to place Attachments on the Poles. <br /> <br />1.12. Permit means a written authorization of the City for the Licensee to make, or maintain, <br />Attachments to specific Poles. <br /> <br />2 <br />
