Sec. 86.005. Extension of lines by city at owner or developer's expense <br />(a) Request to city. In connection with an application for extension of a water or • <br />wastewater line the owner or developer of property may submit a request to pay the city <br />to construct a water or wastewater line to serve development on the property in lieu of <br />construction by the owner or developer. <br />(b) City approval of request. The city may, but shall not be required to construct a <br />water or wastewater line with funds provided by the owner or developer to serve a <br />development in lieu of construction by the owner or developer subject to any <br />requirements of this section and any terms and conditions imposed by the city council <br />Before the city may construct facilities under this section the owner or developer shall <br />execute an agreement approved by the city council setting forth the terms and conditions <br />under which the city will perform such service. <br />(c) Bidding and contract. If the city agrees to extend the water or wastewater line <br />the city's procedures for competitive bidding and the award of contracts established by <br />applicable provisions of the Texas Local Government Code and ordinances must be <br />followed. The city shall not solicit bids for construction until the owner or developer has <br />entered into a contract approved by the city council under subsection (b) and received the <br />developer guarantee under subsection (d). <br />(d) Developer guarantee. As a condition of granting the developer's request to <br />extend a water or wastewater line, the developer shall deposit cash or execute a payment • <br />bond or letter of credit in such form as acceptable to the city, in its sole discretion in an <br />amount equal to 100 percent of the projected costs of the extension less the added cost <br />resulting from oversizing requested by the city, if applicable <br />Sec. 86.006. Health and safety extensions to serve individual lots. <br />For paramount public purposes of health and safety, the city council may authorize <br />the city, at its expense, to extend a water or wastewater line to individual residential <br />areas, subdivisions or lots. <br />Sec. 86.007. Other public purpose extensions by the city <br />For other lawful public purposes, the city council may authorize the city, at its <br />expense, to extend water or wastewater lines to an approved location <br />Sec. 86.008. Water wells to be abandoned. <br />No owner or developer of property having one or more water wells may connect from <br />such property to a city water or wastewater line unless such owner or developer first <br />abandons the water well or wells on the property under applicable water well <br />abandonment laws and regulations. The requirements of this section may only be waived • <br />by the city council. <br />
