• DIVISION 3. PRO RATA FEES FOR WATER AND <br />WASTEWATER LINE EXTENSIONS <br />Sec. 86.009. Effective date. <br />This division shall apply to water and wastewater line extensions for which <br />application is made on or after October 1, 2010. <br />Sec. 86.010. Pro rata fees to be established. <br />(a) Nature of fee. A charge known as a "pro rata fee" may be assessed against all <br />property abutting the easement or ubp lic right -of -way in which a water or wastewater line <br />is located and that is eligible to be served by the line and for which a pro rata fee <br />assessment has been requested and approved or imposed in accordance with this division <br />The pro rata fees collected will be used to reimburse all or a portion of the eligible costs <br />to construct the line. The pro rata fees collected will be paid to the owner or developer <br />that constructed the line, subject to the limitations of this division and applicable law. If <br />the city constructs or pays any portion of the costs to construct the line any pro rata fees <br />collected will be paid to the city in proportion to its participation subject to the <br />limitations of this division. <br />(b) Calculation of pro rata fee. The total cost of the water or wastewater line <br />• together with all appurtenances, as approved and determined by the director will be <br />apportioned across the length of the line establishing a unit cost per linear foot The <br />amount of the pro rata fee assessed against any property shall be the unit cost per linear <br />foot multiplied by the number of linear feet of the front footage of the subject property <br />that abuts the easement or public right -of -way associated with the water or wastewater <br />line for which pro rata fees have been authorized. If the easement or public right -of -way <br />associated with the line is abutted on two or more sides by tracts or parcels of land <br />subject to the pro rata fee assessment the pro rata fee will be divided equally or <br />proportionately between or among the abutting_ properties <br />(1) Determining front footage: Front footage is measured along the length in feet <br />along the property line of a tract or parcel of land which abuts the easement or <br />public right -of -way associated with the line. If the property abuts more than one <br />easement or right -of -way, associated with a line subject to reimbursement from <br />pro rata fees, the property shall be subject to the pro rata fee assessment <br />associated with the line to which a connection will be made. Thereafter, the <br />property may be subject to additional assessments associated with any additional <br />lines to which connections are made if any. <br />(2) Alternate fee calculation. If the director finds that property subject to a pro rata <br />fee assessment is so situated or shaped that applying the front footage calculation <br />• above results in an inequitable allocation of the pro rata fee assessment relative to <br />other property in the line's service area he or she may apply an alternate fee <br />
