Consider adoption of Ordinance 2008-54 on emergency, amending the City's 2008-2009 <br />budget to transfer $2,039,500.00 from the Electric Utility Fund balance for system capital <br />improvement projects; and declaring an emergency. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance 2008- <br />54, on emergency, as previously captioned.. The motion carried unanimously. <br />19. Consider adoption of Ordinance 2008-55 on emergency, amending the City's 2008-2009 <br />budget to transfer $28,510.51 from the Police Asset Forfeiture Fund for the purchase of <br />furniture for the police evidence room; and declaring an emergency. <br />MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Terry, the City Council voted seven (7) for and none (0) opposed, to approve <br />Ordinance 2008-55, on emergency, as previously captioned.. The motion carried unanimously. <br />20. Consider adoption of Ordinance 2008-56 on emergency, amending Chapter 2, <br />Administration, Section 2.569 of the San Marcos City Code to permit the City Council to <br />award bids for the purchase of real property, personal property that is not affixed to real <br />property, or services to bidders with a principal place of business in the city if their bids <br />are within 5% of the lowest bid price received from a non-resident bidder; declaring an <br />emergency; and declaring an effective date. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve Ordinance <br />2008-56, on emergency, as previously captioned.. The motion carried unanimously. <br />21. Consider an ordinance increasing surcharge rates for industrial wastewater discharges <br />under Section 86.132 of the City Code; setting rates for wholesale water treatment, <br />wholesale water sales and reclaimed water sales; and including procedural provisions; and <br />consider ordinance on the first of three readings. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Jones, the City Council voted seven (7) for and none (0) opposed, to table items 17 and 21 until <br />staff can review and report back to Council. The motion carried unanimously. <br />22. Reconsideration of Ordinance 2008-51, adopted November 3, 2008. amending the <br />official zoning map of the city by rezoning 40.72 acres, more or less, tract of land from <br />Light Industrial District (LI), Heavy Industrial District (HI), and General Commercial <br />District (GC) to Multi-family Residential District (MF-12); located at the north end of Mills <br />Street and including procedural provisions. <br />There was no reconsideration of Ordinance 2008-51.
