• 23. Presentation and discussion on the proposed Riverway Development and requested <br />Development Agreement. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted six (6) for and none (0) opposed, with Councilmember Thomaides <br />being absent from the dais, to table this item until staff brings it back. The motion carried. <br />24. Discussion on the current City of San Marcos Disconnect Policies and Procedures and <br />provide direction to staff. <br />Gloria Parrish, 624 E. Hopkins, with the Society of St. Vincent de Paul, stated that most of their <br />assistance is for utilities. She noticed in there is a Lifeline Assistance Program and asked who is <br />eligible to apply. She asked what can the City do for poor and needy people? When both <br />electricity and water are cut off, they are essentially homeless. Last fiscal year the Society spent <br />$50,000 to city utilities alone. She stated that what the city does is admirable, but it is minimal. <br />Dolores Crittendon, 517 Patricia Drive, Director of Salvation Army of Hays County, stated that <br />she has seen a lot of changes, and her concern is what can the city do to resolve the problem or at <br />least make it better for those they work with every day? She reported they see 20-30 people <br />every day. When individuals have the option of two bills, then they may also have the option of <br />keeping one service on. The Salvation Army doesn't have a big budget. In October they spent <br />over $6,000 and before that $7,000. That is in addition to what St. Vincent de Paul and other <br />area churches are doing. It is a sad situation. She also pointed out that if they get the money <br />• together, there is an additional reconnect fee. <br />Steve Parker, Interim Director of Finance, directed the Council to the Disconnection Process <br />Comparison Study provided in the agenda packet. They also researched if cities disconnected <br />utilities independently of each other. <br />25. Discussion on the implementation of an ordinance specifically tailored to deal with <br />issues of graffiti. <br />Howard Williams, Chief of Police, provided a brief presentation to the Council. Possible <br />provisions of a new ordinance would include: 1) making it unlawful to apply or affix graffiti to <br />any public or private property; 2) making it unlawful to possess graffiti implements with the <br />intent to apply or affix graffiti; 3) making it unlawful for the parent or guardian of a juvenile <br />knowingly to permit or by insufficient controls allow a juvenile to apply or affix graffiti; and 4) <br />making it unlawful to fail to remove graffiti. <br />26. Presentation and discussion on the Sagewood Annual Report. <br />Howard Williams, Chief of Police, presented the report on Sagewood Enforcement for Fiscal <br />Year 2008. An ordinance revision will be presented to Council on December 2 that will redefine <br />"unreasonable noise"; define and prohibit an "unruly gathering"; authorize officers to disperse an <br />"unruly gathering"; and make it unlawful to won or maintain an "unruly gathering place". <br />•
