24. Public Hearing to receive comments for and against increasing surcharge rates for <br />industrial wastewater discharges under Section 86.132 of the City Code; setting rates for <br />wholesale water treatment, wholesale water sales and reclaimed water sales; and including <br />procedural provisions; and consider ordinance on the first of two readings. <br />Mayor Narvaiz opened the Public Hearing at 8:02 p.m. on Tuesday, December 16, 2008. <br />There being no comments, Mayor Narvaiz closed the Public Hearing at 8:02 p.m. <br />MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Bose, the City Council voted six (6) for and none (0) opposed, with Councilmember Thomaides <br />absent from the dais, to approve the ordinance on the first of two readings. The motion carried. <br />25. Consider an ordinance amending the traffic register maintained under Section 82.067 <br />of the San Marcos City Code by amending the speed limit of a section of Wonder World <br />Drive (F.M. 3407) eastward beginning at IH -35 to a point 0.157 miles east of Saddler Drive <br />that point being iust east of the South Texas Medical Center; and including procedural <br />provisions; and consider ordinance on first of two readings. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Thomaides, the City Council voted seven (7) for and none (0) opposed, to approve the ordinance <br />on the first of two readings. The motion carried unanimously. <br />• 26. Consider an ordinance amending Chapter 2, Administration, Division 2, Section 2.069 <br />of the San Marcos City Code to provide that attendance at a special meeting, workshop, or <br />committee meeting will no longer be counted as attendance at a regular meeting for the <br />purpose of determining when automatic resignation of a board or commission member has <br />occurred; and declaring an effective date; and consider ordinance on the first of two <br />readings. <br />MOTION: Upon a motion made by Councilmember Couch and a second by Councilmember <br />Terry, the City Council voted six (6) for and one (1) opposed, with Councilmember Jones voting <br />against, to approve the ordinance on the first of two readings, amended to reflect attendance <br />requirements are based on a calendar year. The motion carried. <br />27. Consider adoption on the second and final reading of Ordinance 2008 -62, repealin <br />Article 5, Commercial Animal Establishments, of Chapter 18 Businesses, and amending <br />Chapter 6, Animals, repealing most of the present sections and providing new sections to <br />modernize the chapter and to harmonize the chapter with current state law; providing for <br />criminal penalties, and providing and effective date. <br />Sonya Kraus, 503 Uhland Road #8, recited a verse from a song entitled, "Dog on a Toolbox" and <br />remarked that it may be a beloved mainstay of country songs, but in actuality it is a dangerous <br />practice. It is unsafe for animals and is also unsafe for other motorists. She noted that San <br />Marcos is no longer a small rural community. San Marcos is changing, and along with the <br />economic development benefits there are also challenges involving more traffic and more <br />• people. More people equates to more animals.
