have been authorized by the City to be competitively bid without written consent of the City and <br />the Engineer and with notice to the Contractor. <br />1.7 ADDITIONAL SERVICES /CHANGE IN SERVICES <br />1.7.1 Since the Engineer's compensation is a fixed fee for Basic Services, including minor <br />deviations from those described in this Agreement, compensation to the Engineer for Additional <br />Services will only be for substantial deviations from the scope of services described in this <br />Agreement. The Engineer will submit a written estimate of fees to the City and obtain the City's <br />authorization before initiating any additional services. The following services are not included in <br />this Agreement at present and are specifically considered to be additional services: <br />a) Additional Project coordination meetings with TxDOT or other stakeholders beyond <br />that listed above; <br />b) Right -of -Way and /or condemnation assistance; <br />c) Geotechnical surveys; <br />d) Pavement design; <br />e) Water quality designs and permit assistance; <br />0 Access permit assistance; <br />g) Utility relocation design; <br />h) Illumination designs; <br />i) Materials testing or materials inspection; and <br />j) Preparing for and attending additional public meetings, and /or appearing as an expert <br />witness in any litigation for the City. <br />1.7.2 Each material change (deletion or addition) in the services to be provided by Engineer <br />must be authorized by the City on the Authorization of Change in Services form attached to this <br />Agreement as Attachment B. Compensation for additional services will be in addition to that <br />specified for Basic Services in accordance with Section 15.3 of this Agreement. The approval of <br />the City's governing body is necessary for all additional services the compensation for which <br />exceeds $50,000.00. <br />ARTICLE 2 <br />THE CITY'S RESPONSIBILITIES <br />The City will: <br />2.1 Provide full information to the Engineer regarding the City's requirements for the <br />Engineer's services under this Agreement. The City will furnish the Engineer with copies of <br />official City design standards and construction standards, and other data and information in the <br />City's possession needed by the Engineer at the Engineer's request. <br />2.2 Designate Sabas Avila, Interim Director of Capital Improvements as the City's Project <br />Manager and authorized representative to act on the City's behalf with respect to this Agreement. <br />The City will examine the documents and information submitted by the Engineer and promptly <br />Kimley Horn — Thorpe Lane Project <br />II <br />
