<br />(2) One party personal check. <br /> <br />(3) Money order or traveler's check. <br /> <br />(4) Credit card. <br /> <br />If a wrecker driver is accepting payment under subsection (c), however, the driver must accept cash, a <br />traveler's check or a money order. The driver may decline to accept a credit card or a one-party personal <br />check. <br /> <br />(t) It is unlawful for a person who makes payment for wrecker service charges by personal check or credit <br />card to stop payment on the check or rescind a credit card charge. Persons who wish to contest the propriety <br />of a non-consent tow must request a hearing under V.T.C. A. Transportation Code Chapter 685. Persons <br />who wish to contest excess charges may file a complaint with the chief of police under section 90.294. <br /> <br />Sec. 90.291. Limits on fee amounts. <br /> <br />(a) Category A wreckers: <br /> <br />Service Description Max. fee <br />1. Police-authorized tow from accident scene (all inclusive [double hookup, dollies, $95.00 <br />winching, flatbed, waiting time, cleanup etc.] unless extraordinary recovery, such as for <br />righting overturned vehicle or winching from a waterway, extraordinary cleanup, or <br />waiting time at police request in excess of one hour is confirmed by a police officer) <br />2. Police-authorized tow - Impound/non-accident (all inclusive [double hookup, dollies, $70.00 <br />winching, flatbed, waiting time, cleanup etc.]) <br />3. All other non-consent tows (all inclusive [double hookup, dollies, winching, flatbed, $60.00 <br />etc.]) <br />4. Show-up fee - For non-consent tow where owner requests release of vehicle after the $20.00 <br />wrecker is in position and ready to connect to the vehicle, but before wheels are lifted <br />Drop fee - For non-consent tow where owner requests release of vehicle after wheels are $30.00 <br />lifted but before it leaves the property <br />5. Tire change in connection with a tow: <br />One tire $15.00 <br />Two or more tires $10.00 ea. <br />6. Additional fee for extraordinary recovery, extraordinary cleanup, or waiting time at $20.00/ <br />police request in excess of one hour (all inclusive) Yz hour <br />7. Second vehicle transported by same tow $35.00 <br /> <br />(b) Category B wreckers: <br /> <br />Service Descri tion <br />1.
