If any word, phrase, clause, sentence, or paragraph of this ordinance is held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this ordinance will continue in force if they can be given effect without the invalid portion. SECTION 3. All ordinances and resolution or parts of ordinances or resolutions in conflict with this ordinance are repealed. SECTION 4. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 5. A. This Ordinance will take effect at 12:00 a.m. on the tenth day after the date of its final passage, and the City Secretary will publish notice of its adoption in a newspaper of general circulation in the City. B. Rotation wrecker services and participating storage facility operators operating in the City as of the effective date of this ordinance must register no later than January 31, 2002. C. Towing services rendered prior to the time that the Ordinance becomes effective shall continue to be governed by the regulations and rates applicable at the time they were rendered, regardless of when payment is due or made for the services. For this purpose, service is considered to have been rendered at the time a vehicle is picked up for towing. PASSED ON FIRST READING on December 10, 2001.
