RESOLUTION 2010 - 12 R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY of SAN <br />MARCOS, TEXAS, AUTHORIZING THE SALE TO TEXAS STATE <br />UNIVERSITY -SAN MARCOS OF AN APPROXIMATELY 0.12 ACRE <br />TRACT OF LAND OUT OF THE J.M. VERA.MENDI SURVEY NO. 2, <br />ABSTRACT 17, LOCATED NEAR AQUARENA SPRINGS DRIVE, FOR A <br />PRICE OF $6,261.75; AUTHORIZING THE CITY MANAGER TO <br />NEGOTIATE THE TERMS OF AND EXECUTE A DEED AND SUCH <br />OTHER DOCUMENTS REASONABLY NECESSARY TO <br />CONSUMMATE THE SALE OF SAID PROPERTY; AND DECLARING <br />AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />PART 1. The sale to Texas State University -San Marcos of an approximately 0. 12 <br />acre tract of land out of the J.M. Veramendi Survey No. 2, Abstract 17 as described in Exhibit <br />"A ", attached hereto and made a part hereof, for a price of $6,261.75 is hereby authorized. <br />PART 2. Subject to the reservation of any public utility easements as required to <br />maintain existing public utilities on the property, Interim City .Manager, Laurie Moyer, is hereby <br />r authorized to negotiate the terms and conditions of and execute a deed and such other documents <br />reasonably necessary to consummate the sale consistent with this Resolution. The Interim City <br />Manager may further negotiate terms of payment allowing for a credit to the City in the amount <br />of the purchase price toward the City's future purchase of property owned by Texas State <br />University -San Marcos for the proposed Peques Street realignment. <br />PART 3.
