Consider adoption of Resolution 2008-16R, setting a date of February 17, 2009 for a <br />public hearing regarding the land use assumptions and impact fee engineering report for <br />the purpose of updating impact fees; authorizing the City Clerk to publish anv public <br />notices of the public hearing as may be required by law; and declarine an effective date. <br />30. Consideration of Change Order No.3 for Riverside MKT Project interceptor by Texas <br />Sterling Construction in an amount not to exceed 5184,337.17, and authorize the City <br />Manager to execute Change Order No. 3. <br />31. Consider approval of Change Order No. 7, in an amount not to exceed 538,822.00 to the <br />Post Road Paving and Drainage/Sink Creek Project, and authorize the City Manager to <br />execute Change Order No. 7. <br />Items 15, 22, 24, 25, 29 and 30 were removed from the Consent Agenda. <br />MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, with Councilmember Jones <br />voting against item 12, to approve the Consent Agenda, less Items 15, 22, 24, 25, 29 and 30, and <br />clarifying Item 11 per the City Attorney. The motion carried. <br />. (15)MOTION: Upon a motion made by Councilmember Bose and a second by Councilmember <br />Thomaides, and amended to reflect a date change, the City Council voted seven (7) for and none <br />(0) opposed, to approve Resolution 2009-2R, as previously captioned. The motion carried <br />unanimously. <br />(20)MOTION: Upon a motion made by Councilmember Jones and a second by Councilmember <br />Couch, the City Council voted seven (7) for and none (0) opposed, to reconsider item 20 in order <br />to provide clarification to the public on the high priority item for clearance activities. The <br />motion carried unanimously. <br />Upon a motion made by Councilmember Jones and a second by Councilmember Bose, the City <br />Council voted seven (7) for and none (0) opposed, to approve Resolution 2009-7R, as previously <br />captioned. The motion carried unanimously. <br />(22)MOTION: Upon a motion made by Councilmember Couch and a second by <br />Councilmember Thomaides, the City Council voted seven (7) for and none (0) opposed, to <br />approve Resolution 2009-9R, as previously captioned. The motion carried unanimously. <br />(24)MOTION: Upon a motion made by Councilmember Thomaides and a second by <br />Councilmember Couch, the City Council voted seven (7) for and none (0) opposed, to approve <br />Resolution 2009-11R, as previously captioned.
