inspection of the facility to verify the information provided in the request. Upon <br />completion of its review and investigation. the committee shall provide a written <br />• recommendation to the Director recommending the approval or denial of the <br />request and stating the reasons for its recommendation. Only if the committee <br />determines that the operations at the facility will not result in the generation of <br />fats, oils and grease and/or discharge fats, oils and grease in amounts detrimental <br />to the POTW may the committee recommend approval of the request. Any <br />recommendation for approval of the request shall be conditioned on the <br />requestor's operation of the facility in the manner stated in the request. <br />3) Within 30 davs of receipt of the reauest the Director shall issue to the reauestor a <br />written determination on the request based upon the committee's <br />recommendation. The determination shall state the reasons for the approval or <br />denial of the request. For purposes of this subsection, the Director shall have <br />timely complied if, within 30 days after the Director's receipt of the request, the <br />determination is sent by regular United States mail, hand-delivered to the <br />reauestor or its authorized agent or delivered by electronic mail or facsimile <br />transmission to the requestor. <br />SECTION 2. The former subsection (b) shall become subsection (c) and all subsections <br />thereafter shall be re-ordered according to the appropriate sequence of the alphabet. <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is <br />held to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 5.
