20. The Noise Control Act of 1972, as amended, (42 U.S.C. § 4901 et seq.) <br />Federally - supported facilities and activities shall comply with federal, State, interstate, and <br />local requirements respecting control and abatement of environmental noise to the same <br />extent that any person is subject to such requirements. <br />21. The Native American Craves Protection and Repatriation Act, as amended, <br />(25 U.S.C. § 3001 et seq.) <br />This Act provides a process for returning certain Native American cultural items to lineal <br />descendants, culturally affiliated Indian Tribes, and Native Hawaiian organizations. <br />O. Compliance with Environmental Requirements. The Recipient agrees to notify the Grants <br />Officer of any environmental requirement or restriction, regulatory or otherwise, with which it must <br />comply. Before Project Closeout and final disbursement of Award funds, the Recipient further <br />agrees to provide evidence satisfactory to the Grants Officer that any required environmental <br />remediation has been completed: (1) in compliance with all applicable federal, State and local <br />regulations; and (2) as set forth in the applicable Lease, Finding of Suitability to Lease ( "FOSL "), <br />Lease in Furtherance of Conveyance, Quitclaim Deed, or other conveyance instrument and any <br />amendments, supplements, or succeeding documents. Compliance with said laws or restrictions <br />shall be included in any contract documents for Project construction. The Recipient must certify <br />compliance before final disbursement of grant funds. <br />P. Miscellaneous Requirements. <br />1. Criminal and Prohibited Activities. <br />a. The Program Fraud Civil Remedies Act (31 U.S.C. §§ 3801 -3812) provides for the <br />imposition of civil penalties against persons who make false, fictitious, or fraudulent <br />claims to the Federal Government for money (including grants, loans, or other benefits). <br />b. The Criminal False Claims Act and the False Statements Act (18 U.S.C. §§ 287 and 100 1) <br />provide for criminal prosecution of a person who knowingly makes or presents any false, <br />fictitious, or fraudulent statements or representations or claims against the United States. <br />Such person shall be subject to imprisonment of not more than five years and shall be <br />subject to a fine. <br />c. The Civil False Claims Act (31 U.S.C. § 3729) provides that suits under this Act can be <br />brought by the Federal Government, or a person on behalf of the Federal Government, for <br />false claims under federal assistance programs. <br />d. The Copeland "Anti- Kickback" Act (18 U.S.C. § 874 and 40 U.S.C. § 276c), prohibits a <br />person or organization engaged in a federally - supported Project from enticing an <br />employee working on the Project from giving up a part of his compensation under an <br />employment contract. <br />2. Foreign Travel. <br />a. The Recipient shall comply with the provisions of the Fly America Act (49 U.S.C. <br />§ 40118). The implementing regulations of the Fly America Act are found at <br />41 C.F.R. §§ 301 - 10.131 — 301- 10.143. <br />31 <br />
