ORDINANCE NO. 2010- 41 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "HDR" HIGH DENSITY <br />RESIDENTIAL TO "MDR" MEDIUM DENSITY RESIDENTIAL FOR <br />A 1.35 ACRE, MORE OR LESS, TRACT OF LAND OUT OF THE J.M. <br />VERAMENDI SURVEY NO.2, ABSTRACT NO. 17, LOCATED AT <br />400 BRIAR MEADOW ROAD; AMENDING THE OFFICIAL ZONING <br />MAP OF THE CITY BY REZONING THIS TRACT FROM "FD" <br />FUTURE DEVELOPMENT DISTRICT TO "MF -12" MULTIPLE - <br />FAMILY RESIDENTIAL DISTRICT; AND INCLUDING <br />PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On July 13, 2010, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "HDR" High Density Residential to "MDR" Medium Density <br />Residential, and a concurrent request to change the zoning from "FD" Future Development <br />District to "MF -12" Multiple- Family Residential District, for a 1.35 acre, more or less, tract of <br />land located 400 Briar Meadow Road. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on July 13, 2010, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on August 3, 2010 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "HDR" <br />High Density Residential to "MDR" Medium Density Residential: <br />Street address: 400 Briar Meadow Road <br />Size: 1.35 acres, more or less <br />
