ORDINANCE NO. 2010 - 4 8 <br />AN ORDINANCE OF THE CITY COUNCIL OF <br />THE CITY OF SAN MARCOS, TEXAS <br />AMENDING CHAPTER 14, BUILDINGS AND <br />BUILDING REGULATIONS BY REPEALING THE <br />EXISTING 2003 CODE AND LOCAL <br />AMENDMENTS THERETO AND ADOPTING THE <br />2009 EDITION OF THE INTERNATIONAL <br />CODES WITH LOCAL AMENDMENTS; <br />INCLUDING PROCEDURAL PROVISIONS AND <br />PROVIDING FOR PENALTIES. <br />RECITALS: <br />1. The City currently uses the 2003 Edition of the International Building Code, including <br />Appendices C, E, F, I, and J with local amendments as its authority for regulating <br />construction to reflect the unique needs of the City. <br />2. The nation's major building code agencies have recently merged their codes into one set of <br />international codes so that regulatory authorities and builders will have one set of codes to <br />{` follow, regardless of the project location. <br />3. The State of Texas has adopted the 2001 International Residential Code, the International <br />Energy Code, and the National Electric Code as state minimum standards. <br />4. The City wishes to adopt the 2009 Edition of International Codes, and to make changes to the <br />codes to reflect the unique needs of the City as authorized by Section 214 of the Texas Local <br />Government Code. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />SECTION 1. Chapter 14, Buildings and Building Regulations, of the City Code is <br />repealed in its entirety, and the following is adopted in its place: <br />"ARTICLE 1. IN GENERAL <br />Sec. 14.001. Definitions. <br />International Code means any code published by the International Code Council, Inc. <br />ICC means the International Code Council, Inc. <br />SBCCI means the Southern Building Code Congress International, Inc. <br />
