Maintenance: Alley D.U.E. to be maintained by Homeowner Association. <br />2.3.11. Private Open Space <br />1. Private Open Space Regulations - Owner will designate approximately 5.4 acres as shown on Exhibit <br />"B" as private open space to be maintained by the Property Owners Association. The private open space <br />may contain open space improvements such as a swimming pool, amenity center and other related uses <br />as well as seating, landscaping and irrigation. <br />2. Site Development Regulations - The following site development regulations shall apply to Open Space <br />uses within the Open Space area: <br />A. Minimum Lot size. The minimum Lot size within a Private Open Space area shall be 3,500 <br />square feet, except for landscaped Lots in the right-of-way, which maybe smaller. <br />B. Maximum Height. No buildings within an Open Space shall exceed 35 feet in height. <br />C. Minimum Lot Width. There is no minimum Lot Width within a Private Open Space area. <br />D. Minimum Setbacks. <br />1. Front Yard. The minimum front yard Setback within an Open Space area shall be 15'. <br />2. Side Yard. The minimum Side Yard Setback within an Open Space area shall be 10'. <br />3. Rear Yard. The minimum rear yard Setback within an Open Space area shall be 10'. <br />3. Private Open Space Conveyance - Private Open Space structures thereon shall be conveyed to the <br />Property Owners Association or some other party responsible at time of final plat for maintaining common <br />buildings, areas and land within the community. Private Open Space shall be restricted to the uses <br />specified on the final plat and which provide for the maintenance of Private Open Space in a manner <br />which assures its long term maintenance and for its intended purpose. <br />4. Private Open Space Parking Regulations - Parking for Private Open Space uses within the District is <br />provided from adjacent On-Street Parking unless, at the Developer's option, Off Street parking is provided <br />within an Open Space lot. On-Street Parking may be credited toward the required parking spaces of the <br />intended use. <br />2.3.1.2. Landscaping <br />Landscaping with native, locally adapted, and naturalized Central Texas plants are encouraged to reduce <br />the water, fertilizer, and pesticide needs of the Project.
