• ORDINANCE NO. 2008-49 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE <br />CITY TO RATIFY THE ADOPTION OF THE BLANCO RIVER VILLAGE <br />PLANNED DEVELOPMENT DISTRICT OVERLAY FOR A 103.788 ACRE, <br />MORE OR LESS, TRACT OF PROPERTY, AMEND THE PLANNED <br />DEVELOPMENT DISTRICT BY CHANGING THE ZONING FOR THE UNIT <br />SERIES B FROM "SF4.5" SINGLE FAMILY RESIDENTIAL DISTRICT TO <br />"MF-12" MULTI-FAMILLY DISTRICT AND APPROVING MODIFIED <br />DEVELOPMENT STANDARDS FOR UNIT SERIES A AND UNIT SERIES B; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />RECITALS: <br />1. On September 9, 2008, the Planning and Zoning Commission of the City of San <br />Marcos held a public hearing regarding a request to rezone Block E, lots 1-6, Block F, lots 6-12, <br />and Block H, lots 1-16 (collectively Unit Series B) from "SF-4.5", Single Family Residential <br />District to "MF-12" Multifamily Residential District; and to consider a request to amend the <br />Blanco River Village PDD for Unit Series B and Unit Series A (Block B, lot 15, Block D, lots 1- <br />12 & 15, Block G, lots 1-15, 19-22, 25, 26 & 30,131ock I Lots 1-17, Block J lots 1-22, Block K, <br />lots 1-10), See Exhibit "A" description of property subject to Addendum. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning <br />Commission did, on September 9, 2008, consider and vote to approve the requests, and has <br />recommended that the request be approved by the City Council of the City of San Marcos. <br />3. The City Council held a public hearing on October 21, 2008, regarding the <br />request. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. On September 20, 2004, the City Council adopted Ordinance 2004-61 to establish <br />the Blanco River Planned Development District. That Ordinance was not executed, nor was the <br />PDD placed in the official public records. <br />6. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Blanco River Planned Development District, attached hereto as <br />Exhibit "B" approved by the City Council on September 20, 2004, is hereby ratified.
