SECTION 2. The Addendum to the Blanco River Village Planned Development District attached hereto as Exhibit "C" is hereby approved and to the extent that the Addendum conflicts with the original PDD, the conditions set forth in the Addendum shall prevail. SECTION 3. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the City Land Development Code, is amended to establish the zoning for the following tract of real property from "SF-4.5" Single Family Residential District to "MF-12" Multifamily Residential District, further subject to the conditions set forth in Section 4: Legal description: See the lots described under the MF designation on Exhibit A and the attached map. Deed or plat reference: Volume 12, page 271 of the Plat Records of Hays County, Texas. SECTION 4. The PDD Land Use Plan for the Blanco River Village Planned Development District, as attached to this ordinance (the "Land Use Plan") as Exhibits B and C is approved and adopted to regulate the development of the Project Site. The Project Site will be bound by the provisions of the Land Use Plan and the Development Standards as though they were conditions, restrictions and limitations on use of the Project Site under the City's zoning ordinances. Any person, firm, corporation or other entity violating any provisions of the Land Use Plan or the Development Standards shall be subject to all penalties that apply to violation of the zoning ordinances of the City of San Marcos, as amended. Any person, firm, corporation or other entity violating any provisions of the Land Use Plan or the Development Standards shall be subject to a suit by the City for an injunction to enjoin the violation as though the Land Use Plan and Development Standards were conditions, restrictions and limitations on use of the Project Site under the City's zoning ordinances. SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor and is subject to the penalty provided in Section 1.015 of the San Marcos City Code upon conviction. SECTION 6. After its original passage, this ordinance will be subject to reconsideration at the next regular City Council meeting. If this ordinance is not reconsidered, or if it is reconsidered and approved, notice of its adoption will be published in a newspaper of general circulation in the City. This ordinance will take effect upon publication of this notice. PASSED, APPROVED AND ADOPTED on October 21, 2008, subject to reconsideration at the next regular City Council meeting scheduled for November 3, 2008.
