MOTION: The City Council voted six (6) for and one (1) opposed, Councilmember Thomason voting against, adopt Ordinance 2010 -54, as previously captioned. The motion carried unanimously. 27. Consider adoption on second of two reading on Ordinance 2010 -55. setting the tax rate for the 2010 tax year at 53.02¢ on each $100 of taxable value of real and Personal property that is not exempt from taxation; levying taxes for the use and support of the Municipal Government of the City for the Fiscal Year beginning October 1, 2010, and ending September 30, 2011; providing a sinking fund for the retirement of the bonded debt of the City; including procedural provisions; and providing an effective date. MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember Jones, the City Council voted seven (7) for and none (0) opposed, to adopt Ordinance 2010- 55, as previously captioned. The motion carried unanimously. 28. Consider adoption on second of two readings on Ordinance 2010 -56, increasing the rates for Drainage Utility Services; and including procedural provisions. MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember Thomason, the City Council voted seven (7) for and none (0) opposed, to adopt Ordinance 2010 -56, as previously captioned. The motion carried unanimously. 29. Consider adoption on second of two readings of Ordinance 2010 -57, increasing the rates for Electric Utility Services; and including procedural provisions. MOTION: Upon a motion to reject made by Councilmember Jones, without a second the motion failed. MOTION: Upon a motion made by Councilmember Terry and a second by Councilmember Porterfield, the City Council voted six (6) for and one (1) opposed, Councilmember Jones voting in opposition to the adoption to Resolution 2010 -147R, as previously captioned. The motion carried unanimously. 30. Consider adoption of Resolution 2010 -146R, approving an agreement between the City of San Marcos, Texas and Texas Aviation Partners, L.L.C. for the provision of Airport Management Services for the operation, maintenance and development of the San Marcos Airport; authorizing the Interim City Manager to execute this agreement on behalf of the City; and declaring an effective date. MOTION: Upon a motion made by Councilmember Thomaides and a second by Councilmember Terry, the City Council voted seven (7) for and none (0) opposed, to adopt Resolution 2010 -1468, as previously captioned. The motion carried unanimously. 31. Consider adoption of Resolution 2010 -147R, authorizing the City Attorney to sign an acceptance of the terms of an engagement letter with Charles Soechting, Attorney At Law, to represent and defend Mayor Susan Narvaiz and Council Member Kim Porterfield, in their official capacities, in Case No. 10 -1606, Citizens Minutes of the 9 -21 -10 Regular Meeting Page 7
