ADDENDUM TO CONTRACT FOR TOURISM PROMOTIONAL SERVICES <br />This addendum (the "Addendum ") is entered into by and between the City of San <br />Marcos, Texas, a Texas municipal corporation (the "City ") and the San Marcos Area Chamber of <br />Commerce, Inc. (the "Chamber ") and amends, modifies and supplements that certain Contract <br />for Tourism Promotional Services between the City and the Chamber dated October 1, 2010 (the <br />"Contract "). <br />I. RECITALS: <br />A. Under the terms of the Contract, the City has engaged the services of the Chamber <br />to provide general promotional and tourist advertising to attract tourists and conventions to the <br />City. <br />B. The City similarly contracts with the owners what is now known as San Marcos <br />Premium Outlets to participate in a joint marketing program targeted exclusively to promote <br />retail business and tourism activity in the area of the San Marcos Premium Outlets. <br />C. Following a change in ownership of the San Marcos Premium Outlets in this <br />fiscal year, the scope of the joint marketing program and the amount of City funds required for <br />the program were reduced. <br />D. The City seeks to amend the Contract with the Chamber to enlarge the scope of <br />services of the Chamber to assume the marketing services no longer being provided under the <br />joint marketing program with the owner of San Marcos Premium Outlets. <br />II. AGREEMENT <br />In consideration of the mutual promises and covenants contained herein and good and <br />valuable consideration, receipt of which is hereby acknowledged, the parties agree to amend the <br />Contract as follows: <br />A. Targeted Marketing Program to be Developed The Chamber will facilitate an <br />enhanced advertising and marketing program (the "Program "), developed in collaboration with <br />the City, through its City Manager or his designee. The Program will promote retail business <br />and tourism activity in the City by drawing tourists and visitors to the City's retail outlet centers. <br />The Program shall include, but is not limited to, the following components: <br />advertising in both domestic and foreign magazines and publications; <br />2. creation and distribution of brochures and other publications in other <br />markets; and <br />Page 1 of 3 <br />
