Centerpoint Sign and the Interstate Sign available at no charge to the City and other local non- <br />profit entities for the display of messages or advertisements aimed at promoting tourism and <br />economic development in the City. Within 60 days after the signs are installed and fully <br />operational the Owner shall allot no less than five minutes per hour during each hour of <br />operation of the signs for these messages as follows: <br />a. All messages and advertising proposed by the City or other entity for <br />display on the Interstate Sign or Centerpoint Sign are subject to the prior consent and <br />approval of Owner which shall not be unreasonably withheld. The City, however, is not <br />responsible for the messages of other parties and, subject to the requirements of this <br />section 2.03, the Owner may establish reasonable terms and conditions for such parties as <br />a condition of displaying their messages. For example, the Owner may seek from a non- <br />City party a release of liability similar to the limitation on liability in section 5.04. <br />b. The messages shall be displayed in comparable rotation with commercial <br />messages displayed on the signs rather than being displayed consecutively or in blocks. <br />C. Each message shall be displayed for at least the average length of time that <br />commercial messages on the signs are displayed. <br />d. The messages shall be equitably distributed among all hours of operation <br />of the signs. <br />e. There shall be no distinction between the messages selected for display on <br />the Centerpoint Sign and the messages selected for display on the Interstate Sign. <br />E When a message is displayed, the full display area of the signs shall be <br />devoted exclusively to the message. <br />PART 3. ECONOMIC DEVELOPMENT INCENTIVES PROVIDED BY THE CITY <br />Section 3.01. Waiver of Certain Land Development Code Requirements. The City <br />shall waive the following requirements of the LDC applicable to the Centerpoint Sign and the <br />Interstate Sign: <br />a. the permitted maximum height limits of 25 feet under Section 6.3.3.3 (a) <br />(4) to allow such greater heights for each sign, as applicable, in accordance with the <br />specifications in Exhibit "A "; <br />b. the permitted maximum surface area of under Section 6.3.3.3 (a) (5) to <br />allow such larger surface areas for each sign, as applicable, in accordance with the <br />specifications in Exhibit "A "; <br />C. the requirement for a monument type sign under Section 6.3.3.3 (a) (3) as <br />to the Centerpoint Sign to allow a non - monument sign in accordance with the <br />specifications in Exhibit "A "; <br />2 <br />
