ORDINANCE NO. 2010-59 <br />• AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, CONCERNING A 1,338.584 ACRE, MORE OR LESS, <br />TRACT OF LAND OUT OF THE JOHN WILLIAMS SURVEY, <br />ABSTRACT NO. 471, THE EDWARD BURLESON SURVEY NO. 18, <br />ABSTRACT NO. 63, THE NATHANIEL HUBBARD SURVEY NO. 35, <br />ABSTRACT NO. 230 AND THE ISAAC LOWE SURVEY, ABSTRACT <br />NO. 287 LOCATED IN THE AREA OF HUNTER ROAD AND <br />CENTERPOINT ROAD; AMENDING THE FUTURE LAND USE MAP <br />FROM "HDR" HIGH DENSITY RESIDENTIAL, "OS" OPEN SPACE, <br />AND "I" INDUSTRIAL TO "C " COMMERCIAL FOR A 60.294 ACRE, <br />MORE OR LESS, PORTION OF SAID TRACT; AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY REZONING SAID 60.294 <br />ACRE PORTION FROM "FD" FUTURE DEVELOPMENT DISTRICT TO <br />"PDD" PLANNED DEVELOPMENT DISTRICT WITH BASE ZONING <br />OF "GC" GENERAL COMMERCIAL DISTRICT; AMENDING THE <br />OFFICIAL ZONING MAP OF THE CITY BY REZONING A 1,278.29 <br />ACRE, MORE OR LESS, PORTION OF SAID TRACT FROM "FD" <br />FUTURE DEVELOPMENT DISTRICT TO "PDD" PLANNED <br />DEVELOPMENT DISTRICT WITH BASE ZONING OF "MU" MIXED <br />USE DISTRICT; APPROVING A LAND USE PLAN AND <br />• DEVELOPMENT STANDARDS FOR THE PASO ROBLES PDD; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br />RECITALS: <br />1. On July 27 and August 10, 2010, the City Planning and Zoning Commission of <br />the City of San Marcos held public hearings concerning a 1,338.584 acre, more or less tract of <br />land out of the John Williams Survey, Abstract No. 471, the Edward Burleson Survey No. 18, <br />Abstract No. 63, the Nathaniel Hubbard Survey No. 35, Abstract No. 230 and the Isaac Lowe <br />Survey, Abstract No. 287 located near Hunter Road and Centerpoint Road as described in the <br />attached Exhibit "A" (the "Project Site ") as follows: <br />(a) regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "HDR" High Density Residential, "OS" Open Space <br />and "I" Industrial to "C" Commercial for a 60.294 acre, more or less, portion of the <br />Project Site out of the Edward Burleson Survey No. 18, Abstract No. 63 located east of <br />Hunter Road and south of Centerpoint Road as described in the attached Exhibit "A -1" <br />( "Tract A "); <br />(b) regarding a request to change the zoning for Tract A from "FD" Future <br />Development District to "PDD" Planned Development District, with base zoning of "GC" <br />General Commercial District; and <br />
