(c) regarding a request to change the zoning for a 1,278.29 acre, more or less <br />portion of the Project Site out of the John Williams Survey, Abstract No. 471, the Edward <br />Burleson Survey No. 18, Abstract No. 63, the Nathaniel Hubbard Survey No. 35, <br />Abstract No. 230 and the Isaac Lowe Survey, Abstract No. 287 located at the terminus of <br />Hunter Road and Centerpoint Road as described in the attached exhibit "A -2" ( "Tract B ") <br />from "FD" Future Development District to "PDD" Planned Development District, with <br />base zoning of "MU" Mixed Use District. <br />2. Subsequent to the public hearings on such dates, the Planning and Zoning <br />Commission, on August 10, 2010, considered and voted to approve the requests, and has <br />recommended that the requests be approved by the City Council of the City of San Marcos. <br />3. The City Council held a public hearing on August 31, 2010, regarding the <br />requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Map of the San Marcos Horizons City Master Plan <br />is revised to change the future land use designation from "HDR" High Density Residential, "I" <br />Industrial and "OS" Open Space to "C" Commercial for following portion of the Project Site: <br />TRACT A: <br />Street address: East of Hunter Road and south of Centerpoint Road <br />Size: 60.294 acres, more or less <br />Legal Description: A 60.924 acre, more or less acre tract of land out of the Edward <br />Burleson Survey No. 18, Abstract No. 63 as described in the <br />attached Exhibit "A -1" <br />Deed reference: As shown in the attached Exhibit "A -1 ". <br />• <br />is <br />SECTION 2. The Official Zoning Map of the City, as described in Section 4.1.2.2 of the <br />City Land Development Code, is amended to rezone the following tracts of land comprising the <br />Project Site from "FD" Future Development District to "PDD" Planned Development District, <br />with base zoning as described below, subject to the provisions of the Land Use Plan and <br />Development Standards described in Section 3 of this Ordinance: 0 <br />
