<br />125. <br /> <br />Interlocal Agreement between <br />City of San Marcos and San Marcos Consolidated Independent School District <br />New San Marcos High School Development <br /> <br />Effective Date: <br /> <br />May 4, 2005 <br /> <br />Parties: TIlls agreement is between the City of San Marcos (the "City") and the San <br />Marcos Consolidated Independent School District (the "School District"). <br /> <br />Recitals <br /> <br />1. The School District is planning to develop a new San Marcos High School facility <br />(the "High School Project") on a 98.66 acre, more or less, site (the "Project Site") <br />located near the intersection of McCarty Lane and Old Bastrop Road, within the <br />City limits of the City. <br />2. The City has enacted a Land Development Code (the "LDC") that includes <br />regulations for developments such as the High School Project, including parking <br />and landscaping requirements. <br />3. In an effort to fully comply with, and in some cases, exceed, the parking and <br />landscaping requirements of the LDC, the School District is proposing to take a <br />phased approach toward meeting these requirements as they relate to the High <br />School Project. This approach has several benefits to both the School District and <br />the City: <br />. The initial cost savings will allow the School District to concentrate its bond <br />funds on educational facilities, i.e. classrooms; <br />· The phased approach will allow for the construction of sufficient parking to <br />meet the High School Project's short-term needs while temporarily limiting <br />the amount of impervious cover until enrollment and other factors necessitate <br />construction of additional parking; <br />· Phasing of landscaping requirements will allow the School District to initially <br />concentrate its landscaping in the most visible part of the "developed area" of <br />the Project Site, ensuring an aesthetically pleasing appearance while allowing <br />time to establish a Tree and Shrub Donation Program to fully landscape the <br />remainder of the developed area of the Project Site as well as non-developed <br />areas such as the athletic fields; and <br />· The phased approach will allow the School District time and resources to <br />exceed some of the City's requirements, such as providing 13% green space <br />instead of the 10% required by the LDC. <br /> <br />Agreement <br /> <br />In consideration of the mutual covenants contained in this Agreement, the City and the <br />School District agree as follows: <br /> <br />Section 1.
