• There being no further comments, the Public Hearing was closed at 11:40 p.m. <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council Member <br />Scott, the City Council voted (7) for and (0) opposed, to adopt Ordinance 2011 -12 on the first of two <br />readings. The motion carried. <br />21 8.00PM Public Hearing to receive comments for or against Ordinance 2011 -10 amending <br />section 4.3.4.2 of the Land Development Code pertaining to the issuance of conditional use <br />permits for on- premises consumption of alcoholic beverages in the central business area zoning <br />district; increasing the number of unrestricted permits from 12 to 14; providing that <br />conditional use permits for on- premises consumption in the central business area district shall <br />be issued to a particular building; providing for revocation of permits for non -use; removing <br />limits on gross receipts from the sale of alcoholic beverages previously applied to holders of <br />restaurant permits; eliminating gross receipts reporting requirements; reducing the required <br />number of entrees from eight to three, providing for review of this ordinance by the City <br />Council within one year of its <br />adoption; providing a savings clause; providing for the repeal of any conflicting provisions; <br />and providing an effective date, and consider adoption of Ordinance 2011 -10. <br />At approximately 11:42 p.m. Mayor Guerrero opened the Public Hearing. <br />. There being no further comments, the Public Hearing was closed at 11:43 p.m. <br />MOTION: Upon a motion made by Council Member Jones and a second by Council Member <br />Scott, the City Council voted (7) for and (0) opposed, to postpone action on this item until April 5, <br />2011, so that staff could meet with downtown groups and bring back their recommendations to <br />Council. The motion carried <br />NON - CONSENT AGENDA <br />22 Consider approval on first of two readings Ordinance 2011 -11 amending section 2.566 of <br />the San Marcos City Code to authorize the City Manager to approve individual change orders <br />in amounts not to exceed $100,000 each in circumstances involving a public calamity, <br />unforeseen damage to public machinery, equipment or property or when otherwise necessary <br />to preserve or protect the health or safety of City residents; requiring the City Manager to <br />make quarterly reports to the City Council of each change order in excess of $25,000 approved <br />under the authority of this Ordinance, including procedural provisions; and declarine an <br />effective date. <br />MOTION: Upon a motion made by Council Member Jones and a second by Council Member <br />Thomason, MOTION TO AMEND: Upon a motion made by Council Member Jones and a second <br />by Council Member Thomason, the City Council voted (7) for and (0) opposed, to amend to state <br />that they will reconsider this at the appointment of any new City Manager in the future.
