Mr. Taylor inquired whether the majority of the proposed <br />historic district residents supported the proposed Ordinance. Mr. <br />Vanouderkerke stated the majority of residents who attended the public <br />meeting supported the proposed Ordinance. Mr. Thomaides stated that he <br />spoke with our City Attorney and the outside attorney hired by the city <br />regarding his participation in a vote on a historic district that he lived <br />in. He stated that he also asked them about his participation in a <br />proposed historic district that he did not live in, and one that he was not <br />even in the notification area for. He said he was told there is no legal <br />reason why he would be required to abstain from a proposed area that he did <br />not live in. He also stated that he had reviewed the Ethics Board minutes <br />and the proposed historic district being considered was not listed on their <br />agenda and to his understanding they did not provide a recommendation on <br />his participation on it. He stated that he supports this proposed <br />ordinance because after the town's founding fathers moved to San Marcos and <br />started business in our downtown, this is the area where they lived. <br /> <br />On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Diaz, Guerrero, Narvaiz, Thomaides, Bose and Taylor. <br /> <br />NAY: None. <br /> <br />ABSTAIN: Mihalkanin. <br /> <br />Mayor Narvaiz introduced for consideration a public hearing and approval of <br />an Ordinance on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />REDESIGNATING REINVESTMENT ZONE NO. 2 FOR TAX ABATEMENT PURPOSES <br />PURSUANT TO CHAPTER 312 OF THE TEXAS TAX CODE, CONSISTING OF 110.859 <br />ACRES OF PROPERTY, MORE OR LESS, LOCATED IN THE 3000 AND 3100 BLOCKS <br />OF IH-35 NORTH AND THE 1900 AND 2000 BLOCKS OF TECHNOLOGY WAY; MAKING <br />STATUTORY FINDINGS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Mayor Narvaiz opened the public hearing and asked if anyone wished to <br />speak. No one did, so Mayor Narvaiz closed the public hearing. Mr. Taylor <br />moved for approval of the Ordinance on first reading, and Mr. Diaz seconded <br />the motion, which passed unanimously. <br /> <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE 2004-2005 CITY BUDGET TO PROVIDE FUNDING FOR AN ECONOMIC <br />DEVELOPMENT AGREEMENT BETWEEN THE CITY AND GLOBAL ROCK INVESTMENTS, <br />LTD.; AND INCLUDING PROCEDURAL PROVISION. <br />
