U<tI <br />iI:~ >-(1) <br />~ 1-- <br />-0 <br />U>. <br />t( ~ - <br /> (3 <br /> <br />46. <br /> <br />ORDINANCE 2005- 47 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS, AMENDING SECTION 58.127 OF <br />THE CITY CODE SETTING AND INCREASING THE <br />AMOUNTS OF VARIOUS LIBRARY-RELATED FEES; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING <br />FOR PENALTIES. <br /> <br />RECITALS: <br /> <br />1. Section 58.127 of the City Code authorizes the City Council to set the amounts of fees <br />related to services provided by the San Marcos Public Library. <br /> <br />2. Library fines and fees were last revised in 1999. <br /> <br />3. The Library Board has recommended increases in the amounts of certain fees for <br />library-related services; setting fees for exam proctoring services; authorizing a limited <br />service library card for nonresidents; and, increasing the overdue fees for popular materials <br />in order to recover more of the City's costs in providing the services to the public. <br /> <br />4. The City Council wishes to amend this City Code section to increase the amounts of <br />certain fees for library-related services; set fees for exam proctoring services; authorizing a <br />limited service library card for nonresidents; and increasing the overdue fees for certain <br />materials. <br /> <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS. TEXAS: <br /> <br />SECTION 1. Section 58.127 of the City Code is amended by adding section U) as follows: <br /> <br />Sec. 58.127. Fees and charges for library services. <br /> <br />(a) Use of the library shall be free of charge to all persons who reside in or own <br />property in the city, subject only to the fees and charges specifically authorized by this <br />division. <br /> <br />(b) Use of the library shall be free of charge to all persons under the age of 18 <br />who reside outside the city and within the area of the San Marcos Consolidated <br />Independent School District. <br /> <br />(c) All other persons who reside outside the city may use the library upon paying <br />a fee established by the city council. <br /> <br />(d) Other entities such as counties, school districts or Gary Job Corps may enter <br />into agreements with the city in order to allow their constituents who reside outside the <br />city to use the city library without an annual user fee. <br />
