<br />(e) In order to borrow library materials or equipment, users must first obtain and <br />present a library card. <br /> <br />(f) Charges for damaged, but repairable, library material or equipment shall be <br />based on the cost of repairing the damaged item as determined by the library director. <br /> <br />(g) Charges for lost or irreparably damaged library material or equipment shall <br />include the replacement cost of the item, as determined by the library director, plus a <br />handling fee established by the city council. <br /> <br />(h) Overdue fees established by the city council will be charged for materials and <br />equipment that are not returned on or before the established due date and time. <br />Payment of an overdue fee will not bar prosecution of a person under Section 58.126 of <br />this Code. <br /> <br />(i) The library director may, with the approval of the library board, set incidental <br />fees for postage and materials used to provide library services. Examples of such fees <br />are interlibrary loan and reserve book postage fees, replacement card fees, and fees <br />for photocopies, microfilm prints, and computer copies. <br /> <br />(j) The library director shall. with the approval of the library board. determine the <br />materials to be desiqnated as "popular" thus subiect to an increased overdue fee. The <br />library director shall post notice to patrons of the materials so desiqnated. <br /> <br />SECTION 2. The following fees are set for library-related services under Section 58.127 of <br />the City Code: <br /> <br />Nonresident fee--charge for 12 month full service <br />Nonresident fee--charge for 3 month full service <br />Nonresident fee--charge for 3 month limited service <br />Overdue fee-Children's books <br />Overdue fee-Other materials <br />Overdue fee-Popular materials <br />Overdue fee-Audiovisual equipment <br />Lost/damaged item handling fee <br />Proctoring Exam <br /> <br />$40.00 <br />$15.00 <br />$5.00 <br />1 O~/day <br />20~/day <br />50~day <br />$5.00/day <br />$5.00/item <br />$10.00 exam <br /> <br />SECTION 3. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of <br />this ordinance will continue in force if they can be given effect without the invalid portion. <br /> <br />SECTION 4. All ordinances and resolution or parts of ordinances or resolutions in conflict <br />with this ordinance are repealed. <br /> <br />SECTION 5. Any person violating any provision of this ordinance commits a misdemeanor <br />
