34. Discussion and direction on designating an HCPUA board member to serve on Agency • <br />Litigation Committee. <br />MOTION: Upon a motion made by Council Member Jones and a second by Council Member <br />Porterfield, the City Council voted (7) for and (0) opposed, to appoint Tom Taggart and Jim Nuse, as <br />alternate, to the HCPUA Agency Litigation Committee. The motion carried. <br />35. Hold discussion and receive a presentation regarding the registration for the permitting of <br />itinerant vendors and provide direction to Staff. <br />Police Chief Howard Williams provided a presentation to Council. City Council requested that <br />Chief Williams bring back an Ordinance for adoption in the future. <br />36. Hold discussion regarding the use of temporary food stands in the City and provide <br />direction to Staff. <br />Ken Bell, Fire Marshall, presented the presentation to City Council. City Council consensus was the <br />following: Yes to allowing Mobile Vendors in the City, Yes to allowing them near residential areas, <br />Yes to allowing them near closed businesses in their parking lots (same energy as brick and mortar), <br />Yes to keeping them in improved surfaces <br />Addendum 36.1 — Discuss and consider intercity group with City of Kyle — need 2 <br />representatives to discuss issues. • <br />MOTION: Upon a motion made by Council Member Jones and a second by Council Member <br />Porterfield, the City Council voted (7) for and (0) opposed, to appoint Mayor Daniel Guerrero and <br />Council Member Fred Terry as representatives to an intercity group with the City of Kyle. The <br />motion carried. <br />37. Ouestion and Answer Session with Press and Public. <br />Andy Sevilla — Asked in regards to item #5, Executive Session, if there was anything to report to the <br />public on the City's responsibility. Council stated that direction had been provided to staff. <br />38. Adjournment. <br />MOTION: Upon a motion made by Council Member Thomason and a second by Council Member <br />Terry, the City Council voted seven (7) for and none (0) opposed, to adjourn the regular meeting of <br />the San Marcos City Council at 11:52 p.m. on Tuesday, April 5, 2011.
