• 30. Consider adoption on the first of two readings of Ordinance 2011 -15 amending the Traffic Register maintained under section 82.067 of the San Marcos City Code to change the parking restrictions in the 100 block of Concho Street from "no parking — any time' to "no parking. Monday — Friday 8:00 a.m. to 5:00 mm:" and including procedural provisions. MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Thomason, the City Council voted (7) for and (0) opposed, to postpone item #9 until the next regular meeting on April 19, 2011. The motion carried. 31. Discuss and consider adoption of Ordinance 2011 -10 amending section 4.3.4.2 of the Land Development Code pertaining to the issuance of conditional use permits for on- premises consumption of alcoholic beverages in the central business area zoning district: increasing the number of unrestricted permits from 12 to 14, providing that conditional use permits for on premises consumption in the central business area district shall be issued to a particular building; providing for revocation of permits for non -use; removing limits on gross receipts from the sale of alcoholic beverages previously applied to holders of restaurant permits; eliminating gross receipts reporting requirements; reducing the required number of entrees from eight to three; providing for review of this ordinance by the City Council within one year of its adoption, providing a savings clause, providing for the repeal of any conflicting provisions; and providing an effective date. MOTION: Upon a motion made by Council Member Jones and a second by Council Member • Thomason, the City Council voted (7) for and (0) opposed, to approve Ordinance 2011 -10 on the first of two readings with direction to staff to look at other options for redevelopments and CUPS going with the applicant. The motion carried. 32. Hold discussion and consider adoption of Resolution 2011 -44R petitioning the Texas Alcoholic Beverage Commission to issue an order prohibiting the possession of an open container or the public consumption of alcoholic beverages in the central business area of the City of San Marcos. Texas; and declaring an effective date. MOTION: Upon a motion made by Council Member Terry and a second by Council Member Scott, the City Council voted (7) for and (0) opposed, approved Resolution 2011 -44R. The motion carried. 33. Consider appointments to the Human Service Advisory Board and CAPCOG Clean Air Coalition. MOTION: Upon a motion made by Council Member Porterfield and a second by Council Member Jones, the City Council voted (7) for and (0) opposed, to appoint Jane O' Rourke to the Human Service Advisory Board. The motion carried. MOTION: Upon a motion made by Council Member Prather and a second by Council Member Porterfield, the City Council voted (7) for and (0) opposed, to appoint Council Member Chris Jones to the CAPCOG Clean Air Coalition. The motion carried. •
