The applicant withdrew all of their applications. Therefore, this item was pulled and there was no need • <br />for a Public Hearing. <br />23. 8:OOPM Hold a Public Hearing to receive comments for or against Ordinance 2011 -16 <br />amending the Future Land Use May from "C" Commercial to "HDR" High Density Residential <br />for a 23.99 acre, more or less, tract of land out of the J.M. Veramendi Survey No. 2, Abstract No. <br />17, located at 2112 North IH -35; amending the Official Zoning Map of the City by rezoning said <br />tract from "FD" Future Development District to 'IMF-1811 Multiple - Family Residential District; <br />rezoning a 2.04 acre, more or less, tract of land out of the J.M. Veramendi Survey No. 2, Abstract <br />No. 17, located at the Northeast corner of North IH -35 and River Ridge Parkway from "FD" <br />Future Development District to "GC" General Commercial District; and including procedural <br />provisions; and consider adoption of Ordinance 2011 -16 on the first of two readings. <br />At approximately 9:37 p.m. Mayor Guerrero opened the Public Hearing. <br />Thomas Rhodes, with ETR Development was representing the owners. Wished to say thank you to <br />City Staff for their evaluation and we agree with their analysis. They feel that their request of changing <br />24 acres to MF -18 and having a 2 acre commercial corner is consistent with surrounding development. <br />Planning and Zoning Commission approved this project unanimously. <br />There being no further comments, the Public Hearing was closed at 9:38 p.m. <br />MOTION: Upon a motion made by Council Member Prather and a second by Council Member Jones, • <br />the City Council voted (7) for and (0) opposed, to approve Ordinance 2011 -16 on the first of two <br />readings. The motion carried. <br />24. 8:OOPM Hold a Public Hearing for or against supplementing the Land Development Code by <br />adopting the Downtown SmartCode which establishes rules and regulations for land development <br />within boundaries approved by the City Council. <br />At approximately 8:10 p.m. Mayor Guerrero opened the Public Hearing. <br />Ron Jager, 626 W. San Antonio, stated that there is a very compelling document that the Council has <br />all received a copy of It was written by an authority on urban preservation. Three days were spent <br />surveying downtown last year with a view on how the SmartCode would fit the need for preservation. <br />Mr. Jager felt that it would be arrogant on our part to ignore the advice contained in this document <br />under taken with great care by people and organizations truly concerned with preservation of <br />downtown buildings. He suggested for the sake of convenience that this document be referenced in the <br />SmartCode without the trouble of going through it piece by piece to work it in. He asked that it be <br />labeled or considered an advisory article. <br />James Baker, 727 Belvin St, felt that architectural guidelines and standards would not at all delay the <br />adoption of the SmartCode. It is not to mimic the downtown buildings, but to provide guidance to <br />transition the area. These guidelines need to be developed by architects to be used by builders. These <br />standards used in SmartCode's are supported by preservation groups. • <br />
