116. <br />Regular Meeting July 19, 2005 Page 10 <br />call for approval of the Ordinance on first reading, the following vote was <br />recorded: <br />AYE: Guerrero, Narvaiz and Bose. <br />NAY: Diaz and Taylor. <br />ABSTAIN: Mihalkanin and Thomaides (disclosure affidavits-real property <br />filed with City Clerk). <br />The motion failed. <br />Mayor Narvaiz introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE 2004-2005 CITY BUDGET TO PROVIDE FUNDING FOR LEGAL <br />SERVICES IN CONNECTION WITH THE HOTEL AND CONFERENCE CENTER PROJECT; <br />AND DECLARING AN EMERGENCY. <br />Mr. Mihalkanin moved for adoption of the Ordinance on emergency, and Mr. <br />Diaz seconded the motion. Mr. O'Leary stated he is pleased with the <br />quality of work this firm has provided the City. He also stated this firm <br />has put the Hotel and Conference Center project at the top of their list. <br />The Council then voted unanimously for adoption of the Ordinance on <br />emergency. <br />Mayor Narvaiz introduced for consideration approval of an Ordinance on <br />first reading, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL <br />AMENDING CHAPTER 82, TRAFFIC AND <br />BY ADDING SECTION 82.101 ESTABLI, <br />UPON THE PORTION OF IH-35 WITHIN <br />SAN MARCOS; INCLUDING PROCEDURAL <br />PENALTIES. <br />OF THE CITY OF SAN MARCOS, TEXAS, <br />VEHICLES, OF THE SAN MARCOS CITY CODE <br />3HING LANE USE RESTRICTIONS FOR TRUCKS <br />THE CORPORATE LIMITS OF THE CITY OF <br />PROVISIONS; AND PROVIDING FOR <br />Mr. Diaz moved for approval of the Ordinance on first reading, and Mr. <br />Guerrero seconded the motion. Mr. O'Leary stated in March of 2004, the <br />City of San Marcos sent a Resolution of support to TxDOT for the <br />establishment of truck lanes on IH35 through San Marcos. He stated in May <br />of last year the Texas Transportation Commission approved the Minute Order <br />for the establishment of truck lane restrictions through Williamson, Travis <br />and Hays Counties. He stated TxDOT has now completed the installation of <br />signage along ,IH35 restricting truck traffic from using the inside lane. <br />He also stated in order to enforce the restrictions, the City must adopt <br />this Ordinance. The Council then voted unanimously for approval of the <br />Ordinance on first reading.
