7. The fees may be amended from time to time by resolution of the City Council. • <br />B. Severability <br />If any provision of this ordinance is invalidated by any court of competent <br />jurisdiction, the remaining provisions shall not be affected and shall continue in full <br />force and effect. <br />C. Sewer Surcharge Fees <br />1. Purpose. Non residential Users of the city sanitary sewer system are subject to <br />surcharge fees under this section. The purpose of surcharge fees is to encourage <br />Users who have higher levels of pollutants in their sewage waste than those <br />contained in normal domestic waste to install or modify their pretreatment <br />facilities, or to modify their process operations in order to reduce the pollutant <br />levels in their sewage waste. <br />2. Exclusions from Required Fees. The following types of non residential Users <br />will not be subject to periodic sampling of their sewer discharges under <br />subsection 4 below, or testing fees under subsection 5 below, if their discharge <br />originates only from sanitary conveniences, and they do not share a common <br />water or sewer service line with any type of user listed below: <br />a. Offices; • <br />b. Retail stores; <br />c. Warehouses; <br />d. Apartments and other residential dwellings. <br />3. Sampling Intervals. All sampling of Users will be conducted at intervals of <br />between one and two years. New Users will not be subject to sampling and <br />surcharge fees until a minimum of six (6) months of water usage has occurred. <br />4. Sampling Procedure. <br />a. All sampling shall be conducted by the City at unannounced times. A <br />sample shall consist of a composite of a minimum of four samples collected at <br />approximately equal intervals during the operating period (the posted opening <br />time until one hour after the posted opening time). A duplicate sample will be <br />provided to the user, if requested, for delivery to a laboratory of the User's <br />choice for analysis. The result from the laboratory selected by the User, <br />including a copy of the chain -of- custody form, must be sent by the laboratory <br />directly to the Director within ten days of date of sampling. The laboratory <br />selected by the User must be NELAC certified. <br />0 <br />44 <br />
