<br />g. Cluster Development Plan. <br /> <br />(2) A Watershed Protection Plan (Phase 2), which shall contain greater detail than a <br />Phase 1 Watershed Protection Plan, shall be prepared prior to approval of the <br />following types of development applications: <br /> <br />a. Minor Subdivision Plat or a replat. if the land is located within <br />the Edwards Aquifer Recharge Zone, within a designated stream <br />or river corridor, or if the land contains floodplain, floodway or a <br />waterway as dermed by this Code, <br /> <br />b. Construction plans, <br /> <br />c. Site Preparation Permit, <br /> <br />d. Final Subdivision Plat, <br /> <br />e. Final Development Plat. <br /> <br />(3) The Watershed Protection Plan (Phase 2) shall be consistent with the Watershed <br />Protection Plan (Phase 1). An applicant may elect to submit a Watershed <br />Protection Plan (Phase 2) in lieu of a Watershed Protection Plan (Phase 1). <br /> <br />SECTION 3. Section 1.6.6.l(h) of the City Land Development Code is amended as follows <br />(underlining indicates added text; overstrike indicates deleted text): <br /> <br />(h) Criteria for Approval. The Engineering Director or the Commission on appeal shall <br />render a decision on the construction plans in accordance with the following criteria: <br /> <br />(1) The plans are consistent with the approved Preliminary Subdivision Plat or <br />approved Preliminary Development Plat, or the proposed Final Subdivision Plat or <br />proposed Final Development Plat; <br /> <br />(2) The plans conform to the approved Watershed Protection Plan (Phase 2) and Site <br />Preparation Permit; <br /> <br />(3) The plans conform to the environmental standards, development standards, and <br />standards for adequate public facilities contained in chapters 5, 6, and 7 of this Land <br />Development Code; and <br /> <br />(4) The plans conform to the specifications contained in the City's TCSS. <br /> <br />SECTION 4. Sections 7.1.3.1 and 7.1.3.2, and the title of Division 3 of Article 1 of Chapter <br />7, of the City Land Development Code are amended as follows (underlining indicates added text; <br />overstrike indicates deleted text): <br /> <br />Division 3: City Facilities Utility Participation and Utility Extension and <br />Connection Policies <br /> <br />4 <br />
