<br />The City of San Marcos Facilities Service Contract <br /> <br />The City shall have the right to monitor, inspect and test such metering and weighing devices <br />which are part of the Facilities at any time and for any purpose and to take measurements <br />regarding Influent, Effluent, Residuals and air emissions without unreasonably interfering with <br />the Company's ordinary operations. <br />(C) Quality of Chemicals. The Company shall be responsible for obtaining a <br />Certificate of Analysis from the chemical vendor to ensure that such chemicals meet <br />appropriate quality standards relating to type, concentration, foreign materials and all other <br />factors necessary to verify their suitability for use in the Facilities. Use of a chemical received <br />by the Company for application at the Wastewater Treatment is de facto acceptance of the <br />quality and suitability of the chemical for such use. Use of inappropriate, incorrect or <br />contaminated chemical stock shall not constitute an Uncontrollable Circumstance and shall <br />not relieve the Company of the Performance Guarantees contained in this Service Contract. <br /> <br />63 <br />
