<br />otherwise endeavor to limit probable construction cost to the level of available funds set by the <br />City. <br /> <br />ARTICLE 4 <br />REIMBURSABLE EXPENSES <br /> <br />4.1 Reimbursable expenses, including such things as expenses for plotting, reproduction of <br />documents except bid documents, auto travel mileage, delivery charges, long distance <br />communications, freight, are included in the Consultant's basic services compensation. In <br />addition, the Consultant will be reimbursed for such things as providing fair housing <br />information, affirmative marketing, initial inspections, work write-ups, cost estimating, lead <br />based pain inspection, etc. (the "Soft Costs") at 12% of the total cost per each residence included <br />in the Project. The Soft Costs will not exceed $5,892.75 per residence for a total not-to-exceed <br />Soft Cost reimbursement of $47,142.00 for the entire Project. These costs are included in the <br />total not to exceed amount for the Consutlant's basic services compensation. <br /> <br />ARTICLE 5 <br />PAYMENTS TO THE CONSULTANT <br /> <br />5.1 PAYMENTS ON ACCOUNT OF BASIC SERVICES <br /> <br />Payments for Basic Services will be made to Consultant monthly following receipt by City of <br />Consultant's invoices and appropriate payment requisitions. The amounts of these invoices will <br />be based upon the completion of each milestone on a percentage in accordance with Article 15 of <br />this Agreement, less any disputed amounts, pending resolution thereof. <br /> <br />5.2 PAYMENTS ON ACCOUNT OF ADDITIONAL SERVICES <br /> <br />Payments on account of the Consultant's Additional Services as defined in Section 1.5 will be <br />made monthly upon presentation of the Consultant's statement of services rendered or expenses <br />incurred, less any disputed amounts, pending resolution thereof and an Authorization of Change <br />in Services form executed by the Consultant and the City. <br /> <br />ARTICLE 6 <br />CONSULTANT'S RECORDS <br /> <br />6.1 The Consultant will ensure that the City maintains fiscal records and supporting <br />documentation for all expenditures of funds made under this Agreement in a manner which <br />conforms to OMB Circular A-87, Section 570.490 of the Regulations and this Agreement. Such <br />records must include data on the racial, ethnic, and gender characteristics of persons who are <br />applicants for, participants in, or beneficiaries ofthe funds provided under this Contract. <br /> <br />6.2 All expense records of Consultant will be kept on a recognized accounting basis <br />acceptable to the City and will be available to the City at mutually convenient times. <br /> <br />Langford Contract <br /> <br />11 <br />
