<br />19. <br /> <br />SECOND AMENDMENT TO LEASE AGREEMENT <br /> <br />THIS SECOND AMENDMENT TO LEASE AGREEMENT (this <br />"Amendment") is made as of March 4, , 2002, between FENW A Y PARTNER, <br />L.P., a Delaware limited partnership ("Landlord"), and THE CITY OF SAN MARCOS, <br />TEXAS, a municipal corporation organized and existing under the laws of the State of <br />Texas ("Tenant"). <br /> <br />RECIT ALS <br /> <br />A. GREAT OAK, LLC, as landlord ("Original Landlord"), and Tenant <br />entered into that certain Standard Shopping Center Lease dated November 25, 1997, for <br />certain premises containing approximately 1,529 square feet located in Seguin Five <br />Courts Mall (the "Project") and having an address of 1500 N. Court Street, Suite 480, <br />Seguin, Texas 78155 (the "Premises"), as amended by Amendment #1 to Lease <br />Agreement dated September 2,1998 between Original Landlord and Tenant (as amended, <br />the "Lease"); <br /> <br />B. Landlord is the current owner of the Project and successor to Original <br />Landlord under the Lease; <br /> <br />C. Tenant and Landlord desire to extend the Lease Term for an additional <br />term of sixty (60) months and to amend certain terms thereof as hereinafter set forth. <br /> <br />AGREEMENTS <br /> <br />NOW, THEREFORE, in consideration of the foregoing recitals, the mutual <br />covenants contained herein, and other valuable consideration, the receipt and sufficiency <br />of which are hereby acknowledged by the parties, the parties hereby agree as follows: <br /> <br />1. Recitals: Definitions. The foregoing recitals are true, correct and <br />complete. All capitalized terms used herein and not otherwise defined herein shall have <br />the meanings ascribed to them in the Lease. <br /> <br />2. Term. The term of the Lease is hereby extended for sixty (60) months, <br />commencing April 1, 2002, and ending March 31, 2007 (the "Renewal Term"). <br /> <br />3. Base Rent. The Base Rent for the Renewal Term shall be $1,401.58 per <br />month, commencing on April 1, 2002 and continuing through March 31, 2004, and <br />$1,462.29 per month, commencing April 1, 2004 and continuing through March 31, <br />2007. <br /> <br />4. Additional Expenses.
