<br />39. <br /> <br />RESOLUTION 2002- 48 R <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN INTERLOCAL GRANT CONTRACT <br />BETWEEN THE CITY AND THE CAPITAL AREA PLANNING COUNCIL <br />("CAPCO") FOR GRANT FUNDING FOR A REGIONAL HOUSEHOLD <br />HAZARDOUS WASTE COLLECTION PROGRAM; AUTHORIZING THE <br />CITY MANAGER TO EXECUTE THE CONTRACT AND RELATED <br />DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />RECITALS: <br /> <br />1. The City has received notification that CAPCO has approved funding for a <br />Regional Household Hazardous Waste Collection ("HHW") Program. <br /> <br />2. The City wishes to wishes to enter into a CAPCO Interlocal Grant Contract <br />for the HHW Program. <br /> <br />3. Each party certifies that it has authority to perform this agreement under <br />Chapter 391 of the Local Government Code, and Chapter 361 of the Health and Safety <br />Code, as amended. <br /> <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br /> <br />PART 1. The attached CAPCO Interlocal Grant Contract for FY 2002 Solid <br />Waste Equipment and Services #02-12-GOI between the City of San Marcos and CAPCO <br />is approved. <br /> <br />PART 2. The City Manager, Larry D. Gilley, is authorized to execute the grant <br />contract and related documents on behalf of the City. <br /> <br />PART 3.
